Schedule 1A to HESA makes provision for the VET FEE-HELP Assistance Scheme.  Clause 6 of Schedule 1A provides for the approval of bodies as VET Providers by the Minister, while clause 11 of Schedule 1A provides that the Minister must decide an application for approval as a VET Provider (paragraph 11(1)(a)) and cause the applicant to be notified in writing whether or not the applicant is approved as a VET provider (paragraph 11(1)(b)).

Subclause 12(1) Schedule 1A to HESA stipulates that a Notice of Approval of a body as a VET Provider is a legislative instrument.

Under section 2385 of HESA the Minister has delegated his powers under clauses 6 and 11 of Schedule 1A to HESA to an APS employee in the Department.

Purpose

This instrument approves Community Training Australia Pty Ltd (ACN: 110 125 838 ABN: 28 110 125 838) as a VET Provider under Clause 6 of Schedule 1A to HESA and as a consequence decides the application of Community Training Australia Pty Ltd for the purposes of paragraph 11(1)(a) of Schedule 1A to HESA.  The instrument also gives Community Training Australia Pty Ltd notice of that approval for the purposes of paragraph 11(1)(b) of Schedule 1A to HESA.

Overview

The Explanatory Statement for VET Provider Approval No. 21 of 2011, issued under the authority of the Minister for Tertiary Education, Skills, Jobs and Workplace Relations, relates to the Higher Education Support Act 2003 (HESA). The Act was enacted to provide for the implementation of the VET FEE-HELP Assistance Scheme, which is an extension of the higher education FEE-HELP arrangements aimed at assisting eligible students in the vocational education and training sector to cover their tuition fees. The Explanatory Statement outlines the approval process for bodies corporate that are also Registered Training Organisations (RTOs) to become VET providers. Once approved, these entities can offer VET FEE-HELP assistance to their eligible students studying eligible accredited VET courses. The Minister has delegated the powers to approve VET providers under clauses 6 and 11 of Schedule 1A to HESA to an APS employee in the Department, and this particular instrument approves Community Training Australia Pty Ltd as a VET provider. This approval is effective from the day after the notice is registered on the Federal Register of Legislative Instruments.

Scope and Application

The legislation F2011L02394 under the Higher Education Support Act 2003 (HESA) specifically pertains to the approval of Community Training Australia Pty Ltd as a VET Provider. This approval is granted under Clause 6 of Schedule 1A to HESA, which provides for the approval of bodies as VET Providers by the Minister for Tertiary Education, Skills, Jobs and Workplace Relations. The approval process includes notifying the applicant in writing of the decision, as outlined in Clause 11 of Schedule 1A to HESA. This legislative instrument also serves as a Notice of Approval, formalising the approval as required by subclause 12(1) of Schedule 1A to HESA. The Minister has delegated the power to approve VET Providers to an authorised APS employee in the Department, in accordance with section 238-5 of HESA. The geographic and jurisdictional reach of this legislation is primarily within the Commonwealth of Australia, as it falls under the purview of federal education policy. The legislation applies directly to Community Training Australia Pty Ltd, an entity that has applied for and been granted approval as a VET Provider under the VET FEE-HELP Assistance Scheme. This scheme extends to eligible students who are studying accredited VET courses such as diploma, advanced diploma, graduate certificate, and graduate diploma. The approval allows the entity to offer VET FEE-HELP assistance to its eligible students. The application of this legislation is limited to the specific entity named and does not extend to any other bodies or entities. The approval takes effect on the day after the notice is registered on the Federal Register of Legislative Instruments.

Key Provisions

The key provisions of this legislation, outlined in clauses 6 and 11 of Schedule 1A to the Higher Education Support Act 2003 (HESA), establish the process for approving Vocational Education and Training (VET) providers for the VET FEE-HELP Assistance Scheme. Under clause 6, the Minister for Tertiary Education, Skills, Jobs and Workplace Relations is empowered to approve bodies as VET providers. This means that eligible bodies can apply to offer VET FEE-HELP assistance to their students. Clause 11 stipulates that the Minister must decide on the application for approval and notify the applicant in writing of the decision. If approved, the body is formally recognised as a VET provider, which is documented in a legislative instrument known as a Notice of Approval (subclause 12(1) Schedule 1A to HESA). This approval process ensures that only qualified entities can participate in the VET FEE-HELP scheme. The obligations imposed on Community Training Australia Pty Ltd, as a VET provider under this legislation, include meeting the eligibility criteria for approval, such as being a Registered Training Organisation (RTO), and adhering to the conditions set forth in the Notice of Approval. Once approved, Community Training Australia Pty Ltd must comply with all the requirements of the VET FEE-HELP Assistance Scheme, including ensuring that the assistance is provided to eligible students for accredited VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The approved VET provider must also maintain the necessary records and report to the relevant authorities as required under the scheme. Failure to comply with the provisions of the VET FEE-HELP Assistance Scheme or the conditions of the Notice of Approval can result in various consequences. While specific offences and penalties are not detailed in this explanatory statement, breaches of the scheme could lead to administrative or legal actions. These actions might include fines, suspension, or revocation of the VET provider approval. The maximum penalties for such breaches are determined by the relevant provisions of HESA and other applicable legislation, and could involve significant financial penalties and reputational damage for the provider. It is important for Community Training Australia Pty Ltd to adhere strictly to the requirements to avoid these potential consequences.
