The approval process under the Act ensures that the Minister is satisfied that the body meets the requirements to offer vocational education and training courses eligible for VET FEE-HELP assistance. The objective of the instrument is to enable eligible students to access financial assistance for vocational education and training courses, thereby promoting the right to education as recognised in international human rights instruments.

Scope and Application

This legislative instrument, issued under the Higher Education Support Act 2003, pertains specifically to the approval of entities as Vocational Education and Training (VET) providers, with a particular focus on Cinimod Enterprises Pty Ltd, an approved body corporate and Registered Training Organisation (RTO). The Act facilitates the provision of VET FEE-HELP assistance to eligible students studying certain accredited VET courses, including diploma, advanced diploma, graduate certificate, and graduate diploma. The Minister for Tertiary Education, Skills, Science and Research has delegated their approval powers to an Australian Public Service employee responsible for administering the Act. The approval process ensures that entities meet the requirements outlined in subclause 6(1) of Schedule 1A of the Act. The notice of approval and the decision to approve Cinimod Enterprises Pty Ltd as a VET provider are effective from the day after the notice is registered on the Federal Register of Legislative Instruments, as stipulated by the Legislative Instruments Act 2003. This instrument promotes the right to education by enabling eligible students of Cinimod Enterprises Pty Ltd to access VET FEE-HELP assistance, thus extending the availability of vocational education and training.

Key Provisions

The legislation F2013L00755 under the Higher Education Support Act 2003 primarily addresses the approval of VET providers and the subsequent notification of such approval. Under subclause 6(1) of Schedule 1A to the Act, the Minister is empowered to approve bodies as VET Providers, which are entities eligible to participate in the VET FEE-HELP Assistance Scheme (section 6(1)). Paragraph 11(1)(a) of Schedule 1A mandates that the Minister must decide on applications for approval, and paragraph 11(1)(b) requires that the applicant be notified in writing of the decision (section 11(1)). The Minister has delegated these powers to an APS employee responsible for administering the Act (section 238-5). The approval process culminates in a legislative instrument, a notice of approval, which takes effect the day after it is registered on the Federal Register of Legislative Instruments (section 12(1), (2)). Entities seeking approval must meet specific criteria set out in subclause 6(1) of Schedule 1A to the Act, which ensures they are suitable Registered Training Organisations (RTOs). Once approved, these VET providers can offer VET FEE-HELP assistance to eligible students pursuing accredited VET courses such as diplomas, advanced diplomas, graduate certificates, and graduate diplomas. The obligations imposed on approved VET providers include adhering to the conditions of their approval and ensuring they maintain the standards required to offer VET FEE-HELP assistance. They must also comply with any additional requirements or guidelines set by the Minister or relevant authorities. Failure to comply with the provisions of the Act or the terms of approval can lead to significant consequences. Offences under the Higher Education Support Act 2003 can result in both civil and criminal penalties. While specific penalties are not detailed in the explanatory statement, the Act generally provides for substantial fines and potential imprisonment for serious breaches. For instance, dishonestly obtaining assistance under the VET FEE-HELP Assistance Scheme could lead to penalties including fines of up to $22,200 or imprisonment for up to two years, or both, under section 268A of the Act. Additionally, misleading or deceptive conduct in relation to the scheme may incur penalties under the Competition and Consumer Act 2010.
