Overview
The VET Provider Approval (No 16 of 2009) was issued under the authority of the Minister for Education and provides approval for ParaPharm Pty Ltd as a VET provider, as per subclause 11(1) of Schedule 1A of the Higher Education Support Act 2003. This approval enables ParaPharm Pty Ltd to offer VET FEE-HELP assistance to eligible students studying accredited VET courses. The VET FEE-HELP scheme, an extension of the higher education FEE-HELP arrangements, is an income contingent loan scheme for the vocational education and training sector, aimed at assisting full fee-paying students to cover their tuition fees. The approval process for VET providers under HESA facilitates the expansion of available VET FEE-HELP assistance. The approval takes effect on the day after the last day on which a House of Parliament could have passed a resolution disallowing the notice. Notably, no consultation was deemed necessary as the notice solely benefits ParaPharm Pty Ltd and does not have a direct or substantial indirect effect on business or restrict competition.
Scope and Application
The Notice of Approval issued under subclause 11(1) of Schedule 1A of the Higher Education Support Act 2003 serves to approve ParaPharm Pty Ltd as a VET provider, extending eligibility for VET FEE-HELP assistance to its students. This approval pertains specifically to ParaPharm Pty Ltd, a body corporate that is also a Registered Training Organisation, and enables it to offer VET FEE-HELP for eligible VET courses, including diploma, advanced diploma, graduate certificate, and graduate diploma. The approval's jurisdictional reach is governed by the Higher Education Support Act 2003, which operates under the Commonwealth's legislative authority. Notably, this approval is limited to ParaPharm Pty Ltd, and no broader consultation was deemed necessary as the approval does not impact other entities or alter the competitive landscape. The approval becomes effective on the day after the resolution disallowing period concludes, as per clause 12 of Schedule 1A of HESA.
Key Provisions
The primary sections of the Notice of Approval (F2009L01617) under Schedule 1A of the Higher Education Support Act 2003 (HESA) include the approval of ParaPharm Pty Ltd as a Vocational Education and Training (VET) provider (clause 11(1)). This approval allows ParaPharm Pty Ltd to offer VET FEE-HELP assistance to eligible students. The approval is effective from the day after the last day on which a House of Parliament could have passed a resolution disallowing the notice (clause 12). The notice is intended to extend the benefits of the VET FEE-HELP scheme to the students of ParaPharm Pty Ltd, enabling them to access financial assistance for their VET tuition fees.
Under the provisions of this notice, ParaPharm Pty Ltd, once approved, has the obligation to comply with the requirements of the HESA and any associated regulations concerning the VET FEE-HELP scheme. This includes ensuring that the courses offered are eligible under the scheme and that the students who are receiving assistance meet the eligibility criteria. Furthermore, ParaPharm Pty Ltd must adhere to the administrative and reporting obligations that come with being a VET provider under the scheme.
The Notice of Approval does not specify any direct offences or penalties for breach in its text. However, as an approved VET provider, ParaPharm Pty Ltd is subject to the broader regulatory framework under the HESA and other relevant legislation. Breaches of these obligations could lead to enforcement actions, including fines or other penalties as stipulated in the HESA or related regulations. It is important to note that while the specific penalties are not detailed in this notice, they could be severe given the financial and educational stakes involved.
In summary, the Notice of Approval serves to formalise ParaPharm Pty Ltd’s status as a VET provider, enabling it to offer VET FEE-HELP assistance to its students. The obligations placed on ParaPharm Pty Ltd are primarily to ensure compliance with the HESA and the VET FEE-HELP scheme. While the notice itself does not detail penalties for non-compliance, the broader legislative framework ensures that any breaches could result in significant consequences.
