Overview

The Higher Education Support Act 2003 was enacted to provide a legislative framework that supports higher education and vocational education and training in Australia. This legislation aimed to address gaps in the regulation and funding of the education sector, particularly concerning student loans and support services. The Act was passed by the Australian Parliament and is administered by the Minister for Education, who has the authority to approve bodies as VET providers under Schedule 1A. The policy objective of this legislative instrument is to approve Headmasters Academy Pty Ltd as a VET provider, enabling it to offer VET FEE-HELP assistance to its eligible students. This approval facilitates access to vocational education and training by extending financial assistance to students, thereby promoting the right to education.

The F2014L00248 legislative instrument, issued under the authority of the Minister for Education, pertains to the approval of Headmasters Academy Pty Ltd as a VET Provider under subclause 6(1) of Schedule 1A to the Higher Education Support Act 2003. This approval enables the entity to participate in the VET FEE-HELP Assistance Scheme, facilitating eligible students to access financial assistance for vocational education and training courses. The instrument not only grants Headmasters Academy Pty Ltd the status of a VET Provider but also notifies the entity of this approval, as mandated by the Act. The decision to approve and the notification are effective from the day after the instrument is registered on the Federal Register of Legislative Instruments, in line with the legislative provisions. The approval process ensures that the entity meets the requisite standards to provide vocational education and training under the scheme, thereby promoting access to education for eligible students.

Key Provisions

Subclause 6(1) provides for the approval of bodies as VET providers by the Minister, while paragraph 11(1) requires the Minister to decide an application for approval and notify the applicant in writing of the decision. This particular legislative instrument approves Headmasters Academy Pty Ltd as a VET provider, informs the entity of the approval, and provides the notice of approval as a legislative instrument. The approval allows Headmasters Academy Pty Ltd to offer VET FEE-HELP assistance to eligible students. The Act imposes several obligations on Headmasters Academy Pty Ltd and other approved VET providers. They must ensure that their courses meet certain standards and comply with the Act's requirements. They must also provide accurate information to students about the VET FEE-HELP scheme and their eligibility for it. Furthermore, approved VET providers must maintain records and report to the Minister as required. These obligations are intended to ensure that the VET FEE-HELP scheme operates effectively and benefits eligible students. Breaches of the Act or its regulations can result in various penalties and consequences. For example, providing false or misleading information to the Minister can lead to fines or imprisonment. Failure to comply with reporting or record-keeping requirements can also result in penalties. Additionally, if a VET provider engages in conduct that is contrary to the objectives of the VET FEE-HELP scheme, they may be subject to disciplinary action. The specific penalties for breaches depend on the nature and severity of the breach. This legislative instrument includes a statement of compatibility with human rights, prepared in accordance with the Human Rights (Parliamentary Scrutiny) Act 2011. The instrument engages the right to education, as contained in Article 13 of the International Covenant on Economic, Social, and Cultural Rights. By approving Headmasters Academy Pty Ltd as a VET provider, the instrument promotes the right to education by enabling eligible students to access VET FEE-HELP assistance for VET courses of study. The instrument is considered compatible with human rights as it advances the protection of human rights by facilitating access to education through the VET FEE-HELP scheme.
