AUTHORITY

Clause 39 of HESA provides for the revocation of approval of a body as a VET provider by the Minister if the body requests in writing that the Minister revoke the approval.

Under section 238-5 of HESA the Minister has delegated his powers under clause 39 and paragraph 39(3)(b) of HESA to a person holding the position of Group Manger of the Tertiary Skills and Productivity Group of the Department of Education, Employment and Workplace Relations.

The Notice of Revocation of Approval is a legislative instrument.

PURPOSE

This legislative instrument revokes the approval of Alf Jacka Foundation Ltd (formerly trading as Southern School of Natural Therapies Ltd) as a VET provider under clause 39 of HESA.  The instrument also gives Alf Jacka Foundation Ltd notice of the revocation of approval as required by clause 39(3)(b) of HESA.

BACKGROUND

Southern School of Natural Therapies (now trading as Alf Jacka Foundation Ltd) was approved by the Minister’s delegate as a VET provider on 12 October 2009 by Instrument of Approval No 36 of 2009 registered on the Federal Register of Legislative Instruments on 7 October 2009 (F2009L03734) and which took effect on 11 February 2010.

The Department was advised that on 1 January 2010 agreements were signed for the sale of the business operations and particular assets of the Southern School of Natural Therapies Ltd to Think: Colleges Pty Ltd and Think: Education Services Pty Ltd.

Southern School of Natural Therapies Ltd advised the Department of Education, Employment and Workplace Relations on 28 May 2010 that it changed its name to Alf Jacka Foundation Ltd.

Credit transfer arrangements allowing for any enrolled students to be formally relocated from Alf Jacka Foundation Ltd to Think: Colleges Pty Ltd were finalised 29 July 2010. Subsequently Alf Jacka Foundation Ltd ceased to provide vocational education and training.

COMMENCEMENT

The notice of revocation shall commence on 26 November 2010.

CONSULTATION

Consultation was not undertaken and was not considered necessary because Alf Jacka Foundation Ltd has voluntarily applied for revocation of its approval as a VET provider.

Overview

The Explanatory Statement issued under clause 39 of the Higher Education Support Act 2003 (HESA) outlines the revocation of Alf Jacka Foundation Ltd's (formerly Southern School of Natural Therapies Ltd) approval as a Vocational Education and Training (VET) provider. This revocation is pursuant to a written request from the entity itself, which was processed by the Minister for Tertiary Education, Skills, Jobs and Workplace Relations. The instrument was issued to ensure compliance with HESA provisions and to officially notify Alf Jacka Foundation Ltd of the revocation, which took effect on 26 November 2010. The decision to revoke the approval was made after the entity ceased its operations and transferred its assets and student credits to Think: Colleges Pty Ltd and Think: Education Services Pty Ltd, following agreements signed on 1 January 2010. The revocation was implemented without consultation as the entity had voluntarily applied for the revocation of its approval.

Scope and Application

The Notice of Revocation of Approval under clause 39 of Schedule 1A of the Higher Education Support Act 2003 applies to the Alf Jacka Foundation Ltd, formerly known as the Southern School of Natural Therapies Ltd, which had been approved as a VET provider. This legislative instrument specifically addresses the revocation of this approval and serves as the formal notice of such revocation as mandated by clause 39(3)(b) of the Higher Education Support Act 2003. The revocation follows the entity's written request to the Minister and is executed by a delegate of the Minister, the Group Manager of the Tertiary Skills and Productivity Group within the Department of Education, Employment and Workplace Relations. The revocation is effective from 26 November 2010, following the entity's cessation of vocational education and training operations and the transfer of its business operations and assets to Think: Colleges Pty Ltd and Think: Education Services Pty Ltd. This revocation does not extend to other entities or VET providers and is confined to the specific circumstances of Alf Jacka Foundation Ltd.

Key Provisions

The primary sections of the Notice of Revocation of Approval (F2010L02998) under clause 39 of Schedule 1A of the Higher Education Support Act 2003 (HESA) include clause 39 itself, which outlines the circumstances under which the Minister may revoke the approval of a body as a Vocational Education and Training (VET) provider, and section 238-5, which details the delegation of the Minister's powers to the Group Manager of the Tertiary Skills and Productivity Group within the Department of Education, Employment and Workplace Relations. The instrument serves to revoke the approval of Alf Jacka Foundation Ltd, formerly known as Southern School of Natural Therapies Ltd, as a VET provider, and to notify the entity of this revocation in accordance with clause 39(3)(b) of HESA. The obligations imposed by this Act on the parties involved primarily include the requirement for Alf Jacka Foundation Ltd to formally request the revocation of its approval as a VET provider. This request must be made in writing and directed to the appropriate authority. The Act mandates that the Minister's delegate, in this case the Group Manager of the Tertiary Skills and Productivity Group, must then process the revocation and issue a Notice of Revocation of Approval. This process ensures that the entity is officially notified of the revocation, fulfilling the legal requirement for due process. The Notice of Revocation of Approval also outlines the consequences of non-compliance or breaches of the Act's provisions. While the specific offences, penalties, or civil/criminal consequences are not detailed within the explanatory statement, it is clear that failure to adhere to the Act's requirements could result in legal ramifications. The revocation of approval itself serves as a significant consequence for Alf Jacka Foundation Ltd, preventing it from continuing to operate as a VET provider. This legislative action ensures that the entity complies with the statutory obligations and conditions set forth by HESA.
