EXPLANATORY STATEMENT

 

Notice of Revocation of Approval under clause 39 of Schedule 1A of the Higher Education Support Act 2003

Subject: Schedule 1A of the Higher Education Support Act 2003 (HESA).

Revocation of approval of a body as a VET provider and notice of revocation of approval under subclause 39 (3) of HESA.

 

 

AUTHORITY

Clause 39 of HESA provides for the revocation of approval of a body as a VET provider by the Minister if the body requests in writing that the Minister revoke the approval. 

 

Under section 238-5 of HESA the Minister has delegated his powers under clause 39 and paragraph 39(3)(b) of HESA to a person holding the position of Group Manger of the Tertiary Skills and Productivity Group of the Department of Education, Employment and Workplace Relations.

 

The Notice of Revocation of Approval is a legislative instrument.

 

 

PURPOSE

This legislative instrument revokes the approval of Alf Jacka Foundation Ltd (formerly trading as Southern School of Natural Therapies Ltd) as a VET provider under clause 39 of HESA.  The instrument also gives Alf Jacka Foundation Ltd notice of the revocation of approval as required by clause 39(3)(b) of HESA.

 

 

BACKGROUND

Southern School of Natural Therapies (now trading as Alf Jacka Foundation Ltd) was approved by the Minister’s delegate as a VET provider on 12 October 2009 by Instrument of Approval No 36 of 2009 registered on the Federal Register of Legislative Instruments on 7 October 2009 (F2009L03734) and which took effect on 11 February 2010.

 

The Department was advised that on 1 January 2010 agreements were signed for the sale of the business operations and particular assets of the Southern School of Natural Therapies Ltd to Think: Colleges Pty Ltd and Think: Education Services Pty Ltd.

 

Southern School of Natural Therapies Ltd advised the Department of Education, Employment and Workplace Relations on 28 May 2010 that it changed its name to Alf Jacka Foundation Ltd.

 

Credit transfer arrangements allowing for any enrolled students to be formally relocated from Alf Jacka Foundation Ltd to Think: Colleges Pty Ltd were finalised 29 July 2010. Subsequently Alf Jacka Foundation Ltd ceased to provide vocational education and training.

 

COMMENCEMENT

The notice of revocation shall commence on 26 November 2010.

 

CONSULTATION

Consultation was not undertaken and was not considered necessary because Alf Jacka Foundation Ltd has voluntarily applied for revocation of its approval as a VET provider.
