Subject:  Higher Education Support Act 2003

Amendment No. 3 to the Commonwealth Grant Scheme Guidelines

Section 238-10 of the Higher Education Support Act 2003 provides that the Minister may make guidelines for the purposes of the Act. In particular, section 238-10 specifies that the Minister may make the Commonwealth Grant Scheme Guidelines to give effect to matters set out in Part 2-2 of the Act.

The Commonwealth Grant Scheme Guidelines commenced on 2 June 2004.  These Guidelines amend the Commonwealth Grant Scheme Guidelines.

The Commonwealth Grant Scheme Guidelines are comprised of twelve chapters.  Chapter 2 specifies the higher education providers other than Table A higher education providers that are eligible for grants under Part 2-2 of the Act.  Amendment No. 3 to the Commonwealth Grant Scheme Guidelines adds the names of two new higher education providers, Tabor College and Christian Heritage College, to the list of eligible non-Table A providers in the Guidelines.

Inclusion in chapter 2 of the Guidelines enables the provision of funding for National Priority places at Tabor College and Christian Heritage College.

Overview

The Higher Education Support Act 2003 was enacted to provide a framework for supporting higher education in Australia, ensuring that higher education providers can deliver quality education to students across the country. This Act was introduced to address gaps in the funding and support structures for higher education institutions, ensuring they have the necessary resources to operate effectively and to provide educational opportunities to a broader segment of the population. The Commonwealth Grant Scheme Guidelines, amended by the Higher Education Support (Commonwealth Grant Scheme) Amendment No. 3 Guidelines 2005, are designed to operationalise certain provisions of the Act by detailing the criteria and processes for the distribution of grants under the Act. These guidelines are made by the Minister for Education, Science and Training, in accordance with the authority granted by section 238-10 of the Act. The policy objective of these amendments is to expand the eligibility of higher education providers for Commonwealth funding, thereby supporting a wider range of institutions and enhancing the accessibility and diversity of higher education in Australia. The inclusion of Tabor College and Christian Heritage College in the list of eligible providers under the Guidelines is intended to facilitate the allocation of funding for National Priority places, thus broadening the scope of support available to students at these institutions.

Scope and Application

The Higher Education Support Act 2003, as amended by Amendment No. 3 to the Commonwealth Grant Scheme Guidelines, applies to higher education providers, including institutions that are not classified as Table A providers. This legislation is designed to expand the scope of funding eligibility by specifically adding Tabor College and Christian Heritage College to the list of institutions that can receive grants under the Commonwealth Grant Scheme. The geographic reach of these Guidelines is national, as they pertain to the Commonwealth's authority and apply across Australia. The Guidelines are made under the authority of the Minister for Education, Science and Training, and they serve to operationalise the provisions of the Higher Education Support Act 2003, particularly in relation to funding for National Priority places. These amendments enable the named institutions to receive funding, thereby extending the application of the Commonwealth Grant Scheme to include these additional higher education providers.

Key Provisions

The main operative sections of the Amendment No. 3 to the Commonwealth Grant Scheme Guidelines (sections 238-10 of the Higher Education Support Act 2003) allow the Minister for Education, Science and Training to make guidelines that affect how grants are distributed to eligible higher education providers. Specifically, the amendment to Chapter 2 of the Guidelines introduces two new providers, Tabor College and Christian Heritage College, to the list of non-Table A higher education providers eligible for grants under the Act. This inclusion permits these institutions to receive funding for National Priority places, aligning them with other eligible providers under the Commonwealth Grant Scheme. The Act imposes certain obligations and requirements on the parties involved. Higher education providers must meet specific criteria to qualify for inclusion in the Guidelines, ensuring they are eligible for funding. Additionally, the Minister has a duty to regularly review and update the Guidelines to reflect changes in the higher education landscape, such as the introduction of new eligible providers. These obligations ensure that the grant scheme operates transparently and fairly, supporting the objectives of the Higher Education Support Act. In terms of penalties and consequences for breaches, the Explanatory Statement does not explicitly outline specific offences or penalties related to the Guidelines themselves. However, the overarching legislation, the Higher Education Support Act 2003, provides a framework for enforcing compliance with its provisions. Generally, non-compliance with provisions of the Act can lead to civil or criminal penalties, depending on the nature and severity of the breach. For instance, if a higher education provider fails to meet the eligibility criteria or misuses funds, it could face financial penalties, legal action, or be excluded from the grant scheme. The Amendment No. 3 to the Commonwealth Grant Scheme Guidelines is an important administrative update that facilitates the inclusion of Tabor College and Christian Heritage College in the grant scheme. These changes aim to broaden the scope of eligible higher education providers, ensuring that more institutions can access funding for National Priority places. The Act, by providing the legislative framework, ensures that these changes are implemented in a manner that is compliant with the broader objectives of the Higher Education Support Act 2003.
