High Court Rules (Amendment) 1994 No. 1

EXPLANATORY STATEMENT

STATUTORY RULES 1994 No. 1

Issued by the authority of the Justices of the High Court of Australia

AMENDMENT TO THE HIGH COURT RULES

The recent amendments to Order 69A are further amended as follows:

Order 69A Rule 11 (Abandonment of Application by delay)

Subrule 11(l):

Omit subrule (6) and substitute subrule (8).

This amendment corrects an error in Order 69A, as recently amended.

The rule now provides, as was originally intended, that where an applicant does not prepare and file seven (7) copies of the application book and supply three (3) copies to each respondent within 30 days after receipt of the index, the application is deemed to be abandoned, unless the Court or Justice otherwise orders.
