Authority for payment of allowance.

3. An officer or employee who, in the period that commenced on the first day of January, 1966, and ended on the day immediately before the commencement of these Regulations performed the duties of an office specified in the Fourth Schedule to the High Commissioner (Staff) Regulations as amended by these Regulations shall be paid an allowance of such an amount as would result in the total remuneration of the officer or employee for that period being not less than the total remuneration that would have been payable to the officer or employee in respect of that period if the amendments made by these Regulations had taken effect on the first day of January, 1966.

Overview

The High Commissioner (United Kingdom) Act was enacted in 1909 and has been periodically amended to address various administrative needs related to the High Commissioner’s office. The 1966 amendments to the High Commissioner (Staff) Regulations, specifically Statutory Rules 1966, No. 76, were introduced to revise the salary structures for various staff positions. This legislative instrument was made under the authority of the High Commissioner (United Kingdom) Act 1909–1957 and was notified in the Commonwealth Gazette on 14 April 1966. The amendments aimed to update the remuneration scales for staff members, ensuring that their pay aligns with the roles and responsibilities they undertake within the office. These regulations provide a clear framework for the payment of salaries, ensuring consistency and fairness in the compensation provided to the staff.

Scope and Application

The High Commissioner (United Kingdom) Act 1909–1957, as amended through the High Commissioner (Staff) Regulations Statutory Rules 1966, No. 76, applies to officers and employees of the High Commissioner's Office for the United Kingdom in Australia. These regulations specifically pertain to the remuneration of staff, detailing the annual salaries for various positions specified in the Fourth Schedule. The Act operates within the Commonwealth jurisdiction and is applicable to all personnel specified in the regulations. The Fourth Schedule lists different positions, including clerks, machinists, stenographers, and other roles, along with their corresponding salary rates. Notably, the regulations provide for the payment of an allowance to officers or employees who performed duties prior to the regulations' commencement, ensuring their total remuneration for the period from January 1, 1966, to the day before the regulations' commencement is not less than what they would have received if the amendments had been effective from January 1, 1966.

Key Provisions

The main operative sections of these Statutory Rules pertain to the amendment of the salary structure for officers and staff working under the High Commissioner (United Kingdom) Act. Specifically, Regulation 24 is amended to set out new rates of annual salary for various positions, replacing the previous sub-regulations (1), (2), and (3) (Regulation 2). The new salary rates are detailed in the Fourth Schedule, which lists different roles such as Clerks, Machinists, and Stenographers, each with a corresponding scale of rates in Pounds Sterling. This amendment ensures that the remuneration for these positions is clearly defined and updated. The obligations imposed by these Statutory Rules primarily concern the payment of salaries to the specified officers and staff. According to Regulation 24(1), officers occupying the offices listed in the Fourth Schedule must be paid according to the rates specified there. Furthermore, under Regulation 3, any officer or employee who performed duties during the specified period (from 1 January 1966 to the day before the commencement of these Regulations) must be compensated with an allowance that ensures their total remuneration for that period is not less than what they would have earned if the new rates had been in effect from the beginning of the year. There are no explicit provisions regarding offences, penalties, or civil/criminal consequences for breach within these Statutory Rules. However, the failure to comply with the mandated salary rates could potentially lead to disputes or legal challenges regarding the proper remuneration for the specified roles. The absence of penalties in the text suggests that the enforcement of these salary provisions would likely fall under general employment law and contractual obligations, where breaches could result in legal action for breach of contract or other remedies available under Australian employment legislation.
