Overview

The High Commissioner (Staff) Regulations 1968 were enacted to amend the existing regulations under the High Commissioner (United Kingdom) Act 1909-1966. These amendments were made by the Governor-General in Council, acting on the advice of the Federal Executive Council, to ensure that the staffing regulations for the High Commissioner's office in the United Kingdom remained current and relevant. The regulations address the need to update allowances, salaries, and other conditions of service for staff members. The policy objective behind these amendments is to maintain fair and equitable terms of employment for those working in the High Commissioner's office, reflecting changes in the cost of living and other relevant factors.

Scope and Application

The Regulations Under the High Commissioner (United Kingdom) Act 1909-1966, made under the authority of the Governor-General in Council, specifically govern the staff of the Australian High Commission in the United Kingdom. These regulations apply to officers and employees of the High Commission, encompassing various roles such as stenographers, typists, transcription typists, machine operators, and others. The regulations detail salary structures, allowances, and specific benefits applicable to these staff members. Notably, the regulations address allowances such as the London weighting allowance, proficiency allowances for typing and shorthand skills, shift duty payments, and travel allowances. The scope of these regulations is confined to the staff of the Australian High Commission in the United Kingdom, with no stated exclusions or exemptions. The regulations may be extended or further defined through subordinate instruments, ensuring they adapt to changing administrative needs and conditions.

Key Provisions

The main operative sections of these regulations amend the High Commissioner (Staff) Regulations under the High Commissioner (United Kingdom) Act 1909-1966. Regulation 3 modifies the references to other regulations, replacing "Regulations 24-27" with "Regulations 24-27a" and "Regulations 77-82" with "Regulations 77-81". Regulation 4 updates the definition of "salary" to include the London weighting allowance for officers or employees who receive this allowance. Regulation 24 adds a sub-regulation allowing officers performing temporary duties to be paid at a determined rate without salary reduction. Regulation 27a introduces a new London weighting allowance of £125 per annum for officers or employees whose normal place of duty is within three miles of Charing Cross in London. Regulation 33 replaces the repealed regulation 34 with a new proficiency allowance based on typing and shorthand rates, with the Official Secretary determining the rates of allowance. Regulation 34 introduces a new shift duty payment for machine operators, with allowances for night shifts and other shifts. Regulation 35 revises the travelling allowance rates based on the officer's or employee's annual salary. These regulations impose several obligations on the parties they govern. Firstly, the Official Secretary must determine whether an officer or employee qualifies for a proficiency allowance based on their typing or shorthand rates. If qualified, the Official Secretary must issue a written instrument directing the payment of the appropriate allowance. Additionally, the Official Secretary must decide whether an officer or employee who was performing duties before the regulation's commencement qualifies for a proficiency allowance or London weighting allowance, issuing a written instrument if necessary. The regulations also require the payment of specific allowances for officers or employees performing duties on shifts and for those whose normal place of duty is within three miles of Charing Cross in London. There are no explicit offences, penalties, or consequences for breach stated in the text of these regulations. However, non-compliance with the mandated allowances and payments could potentially lead to legal disputes or administrative actions for non-adherence to the specified terms and conditions. It is important for the parties governed by these regulations to ensure they meet their obligations to avoid such outcomes.
