Overview

Statutory Rules 1970 No. 215, made under the High Commissioner (United Kingdom) Act 1909-1966, was introduced to amend the High Commissioner (Staff) Regulations concerning staff allowances and annual salaries. Enacted by the Governor-General in accordance with the advice of the Federal Executive Council, these regulations aimed to update the allowances and salary scales for various positions within the High Commissioner's office, ensuring that staff remuneration remained competitive and reflective of their skills and duties. This legislative instrument came into operation on 1 January 1971, providing a structured framework for determining allowances based on proficiency in typing, shorthand, and other relevant skills, as well as ensuring that employees received appropriate supplementary and proficiency allowances. The regulations also addressed the need to adjust remuneration retroactively to maintain fairness, particularly for those who had been employed before the regulations' commencement. This adjustment aimed to ensure that employees' total remuneration during the specified period was not less than what they would have earned under the new scales. The policy objective was to provide clear guidelines for staff allowances and salaries, ensuring both fairness and the accurate reflection of employees' qualifications and responsibilities within the High Commissioner's office.

Scope and Application

These regulations under the High Commissioner (United Kingdom) Act 1909-1966 apply to officers and employees who occupy or perform the duties of specified offices or temporary positions within the High Commission for the United Kingdom in Australia. The scope of these regulations includes setting proficiency allowances based on typing and shorthand speeds, as well as supplementary allowances to ensure officers and employees receive remuneration consistent with certain classifications. The regulations also cover allowances for transcribing recorded dictation by typewriter. The allowances are based on specific typing and shorthand speeds and are applicable to various positions such as Stenographer, Grade 1 and 2, Steno-secretary, Grade 1 to 3, Supervisor (Typing), and Transcription Typist, among others. The regulations further outline annual salaries for various clerical and administrative positions within the High Commission. These regulations extend to the entire Commonwealth of Australia, as they are made under the authority of the Commonwealth. There are no stated exclusions or exemptions in these regulations, and they come into operation on the first day of January, 1971. Subordinate instruments may further extend or modify the application of these regulations.

Key Provisions

The Statutory Rules 1970 No. 21, under the High Commissioner (United Kingdom) Act 1909-1966, introduce several significant changes and provisions to the High Commissioner (Staff) Regulations. Regulation 2 introduces a new proficiency allowance for officers or employees who have passed approved tests in typing, writing shorthand, or transcribing by typewriter recorded dictation at specified rates. The amount of the allowance varies depending on the position and the speed achieved in the respective tests, as detailed in the tables within the regulation. These allowances are meant to compensate employees based on their skills and efficiency in their roles. The obligations imposed by these Regulations require employees to pass approved tests to qualify for the proficiency allowances. For instance, a Transcription Typist must pass a typing test at a rate of 40 words per minute to be eligible for an allowance of £50 per annum. Similarly, a Stenographer, Grade 1, must pass a shorthand test at a rate of 130 words per minute to be eligible for an allowance of £120 per annum. The Official Secretary is responsible for approving these tests, ensuring that only those who meet the specified criteria can receive the allowances. Failure to comply with the provisions of these Regulations could lead to several consequences. While the Regulations do not explicitly outline specific penalties for non-compliance, it can be inferred that not adhering to the testing and allowance requirements might result in the denial of the proficiency allowances. Employees found not to meet the necessary qualifications for the allowances could face disciplinary actions or other internal measures by their employers to ensure compliance with the stipulated standards. In summary, the Statutory Rules 1970 No. 21 amend the High Commissioner (Staff) Regulations by introducing new proficiency allowances based on typing, shorthand, and transcribing speeds. Employees must pass approved tests to qualify for these allowances, and adherence to these provisions is essential to receive the compensation. Non-compliance might lead to the denial of allowances and potential internal disciplinary actions.
