Overview

The Statutory Rules 1972 No. 72 were enacted to amend the High Commissioner (Staff) Regulations under the High Commissioner (United Kingdom) Act 1909–1966. This legislative instrument, made by the Governor-General on behalf of the Federal Executive Council, was introduced to update and revise the allowances for various positions within the High Commissioner's staff in response to changes in the remuneration rates. The objective of these regulations was to ensure that the remuneration for staff members reflected the updated allowances as per the newly specified rates, thereby maintaining fair and competitive compensation within the High Commission's staff structure. The regulations specifically addressed the proficiency and shorthand allowances for various positions, including Typist, Stenographer, and Steno-secretary, among others, by updating the rates based on typing and shorthand speeds. Additionally, they provided for a supplementary allowance for officers or employees whose total remuneration would have been higher under the amended regulations if they had been in effect from the beginning of January 1972. These amendments were designed to bring the remuneration in line with the updated rates, ensuring that staff members received appropriate compensation for their roles and responsibilities.

Scope and Application

The Statutory Rules 1972 No. 77, made under the High Commissioner (United Kingdom) Act 1909–1966, pertains to the amendment of the High Commissioner (Staff) Regulations, specifically altering the proficiency and supplementary allowances for various staff positions within the High Commissioner's office in the United Kingdom. These regulations apply to staff members occupying specific offices or positions within the High Commissioner's office, including transcription typists, stenographers, clerical assistants, and others. The amendments set new tables detailing typing and shorthand speeds along with the associated annual allowances. The new regulations also adjust the annual salary scales for various clerical and administrative roles. The changes apply to service periods starting from January 1, 1972, and include provisions for backdated supplementary allowances where applicable. The scope of these regulations is limited to the High Commissioner's office in the United Kingdom, and they extend to cover all staff members employed in roles specified within the amended regulations.

Key Provisions

The Statutory Rules 1972 No. 144 under the High Commissioner (United Kingdom) Act 1909–1966 primarily amend the High Commissioner (Staff) Regulations, specifically Regulation 33 and the Fourth Schedule. Regulation 33 sets out revised rates of proficiency and shorthand allowances for various staff positions, including Transcription Typist, Stenographer, and Typist-in-charge, among others (1). The Fourth Schedule revises the annual salaries for positions such as Clerk, Stenographer, and Supervisor (Typing) (2). Additionally, it provides for supplementary allowances for officers or employees whose remuneration would have been higher under the amended regulations if they had come into effect on 1 January 1972 (3). The new rates apply to allowances paid or payable in respect of service on or after 1 January 1972 (4). These Regulations impose specific obligations on the High Commissioner’s office, requiring them to adjust the remuneration of staff based on the new proficiency and shorthand allowance rates, as well as to calculate and pay any supplementary allowances due to staff members for periods prior to the commencement of these Regulations. Employers must ensure that all staff members are classified and compensated in accordance with the updated tables and scales provided by these Regulations. Failure to comply with these Regulations may result in legal consequences for the High Commissioner’s office, including potential financial penalties for underpayment of staff. While the specific penalties are not detailed in the Regulations themselves, non-compliance with statutory requirements can generally lead to enforcement actions by relevant authorities, which may include fines or other corrective measures. The precise nature and extent of these penalties would be determined by the applicable employment or labour laws in force at the time of any breach.
