Scope and Application
The Heavy Vehicle Stated Maps – Network Suspension and Amendment Notice 2026 (No.10) is a regulatory instrument that applies across all participating jurisdictions within Australia, affecting the heavy vehicle industry by amending the stated networks for certain routes. This notice is particularly pertinent to road managers, heavy vehicle operators, and any other entities or individuals who are directly impacted by the specified routes. The amendments are made under sections 175 and 173 of the Heavy Vehicle National Law, allowing for immediate suspension or amendment of routes to prevent or minimise serious harm to public safety or significant damage to road infrastructure, as well as cancellation or amendment of routes on the Regulator’s initiative. Any affected persons have the right to make written representations to the Regulator within 14 days of the publication of this notice if they believe the amendment should not proceed. The notice specifically alters the Queensland networks, including the removal of certain streets from the intersection routes due to safety concerns, and mandates rerouting to ensure continued operational safety and compliance with national standards.
Key Provisions
The Heavy Vehicle Stated Maps – Network Suspension and Amendment Notice 2026 (No. 10) is a piece of legislation that amends specified routes for heavy vehicles within participating jurisdictions. According to section 4(1)(a) of the Notice, any suspension or amendment of routes listed in Schedule 1 will commence immediately upon publication. Section 4(1)(b) stipulates that cancellation or amendment of routes will take effect 28 days post-publication. The Notice allows for the suspension or amendment of routes to prevent or mitigate serious harm to public safety or significant damage to road infrastructure, as per section 175 of the Heavy Vehicle National Law (HVNL). It also enables the cancellation or amendment of routes on the initiative of the Regulator, under section 173 of the HVNL. The Notice applies universally across all participating jurisdictions, as outlined in the Application section.
Under this Notice, the primary obligations are for the Road Manager to provide reasons for any changes to routes and for affected parties to make written representations to the Regulator if they oppose the amendments. Section 174 of the HVNL mandates that any person adversely affected by the proposed action must submit their objections to the Regulator within 14 days of the Notice's publication. This ensures that the Regulator considers all stakeholder concerns before proceeding with the amendments.
The Notice outlines specific penalties and consequences for breaches. While the Notice itself does not explicitly state penalties, any failure to comply with the provisions could potentially lead to legal ramifications under the HVNL. For example, unauthorised use of routes not listed in the amended networks could lead to fines or other penalties as stipulated by the HVNL. The Regulator, in making these amendments, exercises authority under sections 173 and 175 to ensure that routes are modified to protect public safety and infrastructure integrity. Consequently, non-compliance with the Notice could result in enforcement actions by the Regulator.
