Key Provisions
The Heavy Vehicle Stated Maps – Network Suspension and Amendment Notice 2025 (No.9) (the Notice) primarily amends stated networks for heavy vehicles across South Australia and New South Wales. This amendment aims to prevent or minimise serious harm to public safety or significant damage to road infrastructure, as outlined in section 4(1)(a) and section 4(1)(b) of the Notice. The changes, which take effect immediately upon publication for suspension or amendment and 28 days after publication for cancellation or amendment, are detailed in Schedule 1. The Notice applies to all participating jurisdictions and is made under the Heavy Vehicle National Law (HVNL).
The Notice imposes specific obligations on road managers and heavy vehicle operators. Road managers must assess the impact of heavy vehicle routes on public safety and road infrastructure and either grant or withhold consent for certain routes. For instance, the Department of Infrastructure and Transport (DIT) in South Australia has withheld consent for certain roads in Jamestown due to significant risks to public safety. Heavy vehicle operators must comply with the amended routes and any new conditions or restrictions imposed by the Notice. Any person affected by the Notice has the right to make written representations to the Regulator within 14 days of the Notice’s publication if they believe the amendment should not proceed.
Failure to comply with the provisions of the Notice can result in various consequences. While the Notice does not explicitly state the penalties for non-compliance, breaches of the HVNL generally carry significant fines and potential imprisonment. Under section 155 of the HVNL, a person who contravenes a provision of the HVNL may be liable for a fine of up to 200 penalty units, which currently equates to approximately $42,500. Additionally, under section 161, a person who commits an offence against the HVNL by engaging in conduct that poses a risk of serious harm may face imprisonment for up to five years. These penalties underscore the importance of adhering to the Notice’s provisions to ensure public safety and protect road infrastructure.
