Key Provisions
The Heavy Vehicle Stated Maps – Network Suspension and Amendment Notice 2025 (No.2) (C2025G00040) outlines specific amendments to stated networks for heavy vehicles across various jurisdictions in Australia. Section 4(1)(a) of the notice immediately suspends or amends certain routes listed in Schedule 1 to prevent serious harm to public safety or significant damage to road infrastructure. Section 4(1)(b) cancels or amends these routes 28 days after publication. The notice is applicable in all participating jurisdictions and is made under section 175 to suspend or amend routes and section 173 to cancel or amend routes on the Regulator’s initiative. The specified networks in Column 2 of Schedule 1 are amended as detailed in Column 4, with reasons provided by the Road Manager in Column 5.
The notice imposes obligations on the parties affected by the amendments to the heavy vehicle routes. Any person affected by the purpose of the notice has the right to make written representations to the Regulator within 14 days of the notice’s publication, explaining why the amendment should not be made. This provides an avenue for stakeholders to voice their concerns and objections to the changes proposed. The notice also mandates that the specified networks in the document are amended in accordance with the details provided in Schedule 1. This includes the suspension or cancellation of certain routes for various reasons, such as safety concerns, mapping errors, or changes due to ongoing development and infrastructure projects.
Breach of the provisions outlined in the notice may lead to various consequences. While the notice does not explicitly state specific penalties for non-compliance, it does highlight the importance of adhering to the amended routes to ensure public safety and prevent damage to road infrastructure. Failure to comply with these amended routes could potentially result in legal action, fines, or other penalties as prescribed by the relevant heavy vehicle laws and regulations in participating jurisdictions. Additionally, non-compliance could pose significant risks to public safety and the integrity of road infrastructure, leading to further regulatory actions to enforce compliance.
The notice also provides a mechanism for public input, allowing any person affected by the amendments to make written representations to the Regulator within a specified timeframe. This ensures that all stakeholders have an opportunity to be heard and to challenge the amendments if they believe there are valid reasons for not proceeding with the changes. The notice is designed to balance the need for safety and infrastructure protection with the practical requirements of heavy vehicle operations. By providing a clear process for amendments and public consultation, the notice aims to facilitate effective and transparent governance of heavy vehicle routes across participating jurisdictions.
