Overview

The Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice 2017 (No. 1) was enacted to address the need to temporarily extend the operation of an exemption for silage trailers, which was originally set to expire on 10 June 2015. This amendment extends the exemption for a further two years, allowing continued flexibility in the regulation of silage trailers under the Heavy Vehicle National Law. The Notice was introduced by the National Heavy Vehicle Regulator, acting under Section 23 of Schedule 1 of the Heavy Vehicle National Law, and aims to provide a seamless transition for operators who rely on the exemption for their business activities. This amendment was made to ensure that the exemption continues to operate effectively, allowing for a smooth regulatory environment without abrupt changes that could impact agricultural operations reliant on silage trailers. The policy objective is to maintain consistency and stability in the application of the Heavy Vehicle National Law, ensuring that regulatory adjustments are made in a considered and timely manner.

Scope and Application

The Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice 2017 (No. 1) pertains to silage trailers within the scope of the Heavy Vehicle National Law, extending the exemption from certain national law requirements for a further two years. This Notice applies to silage trailers which were initially exempt under a previous law, and it is designed to provide temporary relief from the compliance requirements stipulated in the national law, thereby allowing continued operation of these trailers under the specified exemption. The amendment extends the exemption period from its original expiry date of 31 January 2017 to a new expiry date of 31 January 2019. The Notice is applicable within Victoria, as it concerns an exemption under a state law that has been harmonised with the national law. The amendment ensures that the exemption remains in effect, allowing silage trailers to continue operating under the conditions set forth in the original exemption until the new expiry date. The scope of the Notice is limited to silage trailers and does not extend to other types of heavy vehicles or trailers.

Key Provisions

The main operative sections of this Amendment Notice, as referenced in the text, pertain to the extension of the exemption in relation to silage trailers under the Heavy Vehicle National Law. Specifically, Clause 5 of the original Notice, which was set to expire on 31 January 2017, has been amended to extend this exemption until 31 January 2019 (Section 5). This means that the exemption originally established to allow certain silage trailers to operate under specific conditions continues to apply for an additional two years. The obligations and requirements imposed by this Amendment Notice are primarily administrative. It mandates the continued application of the exemption for silage trailers, ensuring that these vehicles can continue to operate under the terms set out in the original Notice. The Notice does not introduce new obligations but rather reaffirms the existing conditions and terms of the exemption for an extended period. It is imperative that all parties, including the operators of silage trailers, remain compliant with the conditions of the exemption as outlined in the original Notice. There are no direct offences, penalties, or consequences specified within this Amendment Notice itself. However, any breach of the conditions stipulated in the original Exemption in Relation to Silage Trailers, which this Notice extends, could lead to civil or criminal consequences. Such breaches might include operating a silage trailer outside the permitted conditions, which could result in fines, penalties, or other legal actions as outlined in the corresponding legislation governing heavy vehicles. The specific penalties would be determined by the relevant heavy vehicle laws and would depend on the nature and severity of the breach.
