South Australian Heavy Vehicle Standards (Conditionally Registered Special Purpose Vehicle) Exemption Notice 2019 (No.1)
- Purpose
The purpose of this notice is to exempt a heavy vehicle to which it applies from certain requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).
2. Authorising Provision
This notice is made under section 61 of the Heavy Vehicle National Law as in force in each participating jurisdiction.
3. Commencement
This notice commences on 10 February 2019.
4. Expiry
This notice expires on 9 February 2024.
5. Definitions
Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the Heavy Vehicle National Law.
In this notice—
Conditional Registration means a vehicle registered in South Australia pursuant to the requirements of Section 25 of the Motor Vehicle Act 1959 (SA).
Construction road rollers means steel smooth drum rollers, steel grid rollers, steel sheeps-foot rollers and combination steel smooth drum/ multi-tyred road rollers which do not have their own motive power and which are designed and constructed to only be drawn by a towing vehicle.
multi-tyred road roller means a vehicle fitted with pneumatic tyres and used for the purpose of compacting soil, asphalt and other products used in road construction.
Period of low visibility means any time when, owing to insufficient daylight or unfavourable conditions, persons or vehicles on a road are not clearly visible at a distance of 250 m to a person of normal vision.
Plant equipment vehicle means a vehicle:
(a) built or permanently modified to operate off road, on road related areas, or on an area of road that is under construction or repair; and
(b) is not constructed on a conventional truck chassis
Note: Examples include forklifts, backhoes, bulldozers, excavators, front-end loaders, tractors, agricultural machines, graders, and construction road rollers.
Special purpose vehicle means a conditionally registered vehicle that is an agricultural vehicle or a plant equipment vehicle and does not include a mobile crane.
6. Title
This Notice may be cited as the South Australian Heavy Vehicle Standards (Conditionally Registered Special Purpose Vehicle) Exemption Notice 2019 (No. 1).
7. Application
(1) This notice applies in the State of South Australia.
(2) This notice applies to an agricultural vehicle being driven on a road or road related area for the purpose of:
- Undertaking activities involved directly with primary production; or
- Transport to or from a farm machinery dealership to a place of agricultural operation, display or repair and return; or
- Transport to or from a place of an agricultural operation to another place of agricultural operation.
(3) This notice applies to a plant equipment vehicle being driven on a road or road related area for the purpose of undertaking maintenance and/or construction of roads, road related areas, bridges or culverts.
8. Exemption from Prescribed Vehicle Standards
(1) A multi-tyred road roller is exempt from the requirement detailed in Schedule 2, Section 28 – Tyre tread as detailed in the National Regulation.
(2) A special purpose vehicle mentioned in column four is exempt from the corresponding standard the National Regulation as listed in column three of Table 1.

9. Conditions
A special purpose vehicle is subject to the following conditions:
(a) An Agricultural machine is only exempt from this provision where the primary use of the vehicle is under, in or about trees or vines, or any other place which is too low, or too narrow, for the vehicle to work when the vehicle is fitted with mirrors.
(b) Only when operating within a designated worksite signed in accordance with Australian Standard 1742.3-1996, Part 3 'Traffic Control Devices for Works on Roads' where the vehicle is transported by float (not driven) to and/or between worksites.
(c) A construction road roller which does not have its own motive power may only be towed at speeds detailed below when the towing vehicle is fitted with brakes and the construction road roller has laden mass not exceeding:
- 12 tonnes - 10 km/hr
- 6 tonnes - 25 km/hr
(d) The vehicle must not be driven or used on a road or road related area between sunset and sunrise or during periods of low visibility unless the vehicle complies with Part 6 – Lights and Reflectors of the National Regulation.
(e) The vehicle must not be left standing on a road or road related area between sunset and sunrise or during periods of low visibility unless the vehicle complies with Parking lights in accordance with Part 6 – Lights and Reflectors of the National Regulation
(f) The vehicle must not be operated at a speed exceeding 40 km/h
(g) A vehicle that has its own motive power must be fitted with:
- Brakes to two or more wheels complying with the requirements of Section 87 of the National Regulation.
- A parking brake that operates on at least two wheels and that is capable of holding the vehicle stationary on a 12 percent gradient
- An actuating mechanism for the parking brake that incorporates a device that prevents accidental release of that mechanism and holds the brake in the applied position unless intentionally released by the driver.
