Overview

The South Australia Class 1 Oyster Boat Exemption Notice 2019 (No.1) was enacted to provide specific exemptions and conditions for heavy vehicles towing oyster boats or oyster boats on their own wheels, operating within South Australia. This Notice was made under Section 117 of the Heavy Vehicle National Law (HVNL) and aims to address the operational needs of the oyster harvesting industry by allowing certain dimension exemptions and road network access for these vehicles. The Notice, which commenced on 10 February 2019 and will expire on 9 February 2024, provides eligible combinations with exemptions from certain dimensional requirements and vehicle standards, while imposing specific conditions such as a width limit of 3.5 metres, a speed restriction of 25kph, and limitations on the areas and times of travel. This legislative measure seeks to balance the operational requirements of the oyster industry with safety and regulatory standards.

Scope and Application

The South Australia Class 1 Oyster Boat Exemption Notice 2019 (No.1) applies specifically to heavy vehicle combinations in South Australia that are used for the purpose of towing one trailer carrying an oyster boat or transporting an oyster boat on its own wheels. This Notice operates under the authority granted by Section 117 of the Heavy Vehicle National Law (HVNL) and Section 169 of the Heavy Vehicle (General) National Regulation. It came into effect on 10 February 2019 and is set to expire on 9 February 2024. The Notice exempts eligible combinations from certain dimensional requirements and vehicle standards, such as the width restriction and the necessity for heavy trailer braking systems, provided the gross combination mass does not exceed 6 tonnes. However, these vehicles must adhere to a maximum speed of 25 kph, and their operation is limited to specific times and purposes, such as transporting the oyster boat from the processing site to the beach or boat launching ramp, only during daylight hours unless directly involved in oyster harvesting. The Notice extends to all roads in South Australia but stipulates the permissible areas of operation, ensuring that the exemption is narrowly tailored to the specific industry needs.

Key Provisions

The South Australia Class 1 Oyster Boat Exemption Notice 2019 (No. 1) is an instrument that provides specific exemptions, conditions, and road network access for heavy vehicle combinations that are towing one trailer carrying an oyster boat or an oyster boat on its own wheels. It is important to note that this Notice replaces a previous exemption published in 2001. It is made under Section 117 of the Heavy Vehicle National Law (HVNL) and Section 169 of the Heavy Vehicle (General) National Regulation, and it came into effect on 10 February 2019, expiring on 9 February 2024. This Notice applies to eligible vehicles operating within South Australia and may be cited as the South Australia Class 1 Oyster Boat Exemption Notice 2019. The Notice defines "eligible combination" as a heavy vehicle combination consisting of a vehicle towing one trailer carrying an oyster boat or an oyster boat on its own wheels. The Notice imposes several conditions on eligible combinations. Firstly, these vehicles are exempt from certain dimension requirements as outlined in Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. Specifically, the overall width of the vehicle combination, including the oyster boat trailer, oyster boat, and any framework used to support the boat, must not exceed 3.5 metres. Additionally, eligible combinations must comply with all relevant requirements of Schedule 8 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation, including a speed restriction of 25 kilometres per hour. These vehicles are permitted to operate on all roads in South Australia, but travel is only allowed for the purpose of transporting the oyster boat from the place of processing to the beach or boat launching ramp and back. Travel is also restricted to daytime hours, except when the transportation of the boat is directly involved in the harvesting of oysters. Any breaches of the conditions and requirements outlined in the Notice may lead to various consequences. While the Notice itself does not explicitly state penalties, it is likely that any breaches could be subject to the penalties and enforcement actions provided under the Heavy Vehicle National Law and the relevant national regulations. These could include fines, vehicle impoundment, or other enforcement actions as deemed appropriate by the authorities. It is essential for operators of eligible combinations to adhere strictly to the conditions and requirements to avoid any potential penalties or legal issues.
