South Australia Adelaide Christmas Pageant Vehicle Standards and Dimension Exemption Notice 2019 (No.1)

  1. Purpose

 

This Notice provides vehicle standards and dimension exemptions for vehicles and combinations participating in the annual Adelaide Christmas Pageant.

 

Note: This Notice replaces the Exemption for Adelaide Christmas Pageant Floats, published in the South Australia Government Gazette on 5 October 2006.

 

2.       Authorising Provision

 

1)      This notice is made under the following sections for the heavy vehicle National Law (HVNL):

 

a)      For vehicle standards exemptions – Section 61

b)      For dimension exemptions - Section 117

 

3.       Commencement

 

This Notice commences on the date it is published.

 

4.       Expiry

 

This Notice expires five (5) years from the date it is published.

 

5.       Title

 

This Notice may be cited as the South Australia Adelaide Christmas Pageant Vehicle Standards and Dimension Exemption Notice 2019.

 

6.       Definitions

 

1)      Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

2)      In this Notice:-

Christmas pageant float means a vehicle or combination, either self-propelled or towed by another vehicle, that is constructed and adorned for use in the Adelaide Christmas Pageant.

7.       Application

 

This Notice applies to Christmas pageant floats operating in South Australia.

 

8.       Exemptions - Dimension

 

1)      Christmas pageant floats operating under this notice are exempt from the following dimension requirements in Schedule 6 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation (MDL Regulation)

 

a)      Section 7 – Width

b)      Section 13(a)(ii) and 13(b)(ii) – Side projection

 

9.       Exemptions – vehicle Standards

 

1)      Christmas pageant floats operating under this notice are exempt from the following requirements in Schedule 2 of the Heavy Vehicle (Vehicle Standards) National Regulation:

 

a)      Section 39 - Headlights to be fitted to vehicles

b)      Section 45 - Parking lights

c)       Section 47 - Tail lights

d)      Section 51 - Number plate lights

e)      Section 52 - Front clearance lights

f)        Section 55 - Side marker lights

g)       Section 59 - Fitting brake lights

h)      Section 62 - Direction indicator lights

i)        Section 69 - Reflectors generally

j)        Section 70 - Rear reflectors

k)       Section 73 - Compulsory front reflectors on particular trailers

l)        Section 83 - Turn Signals

m)    Section 11 - Horns, alarms, etc.

n)      Section 12 - Rear vision mirrors

o)      Section 88 - What braking system a heavy motor vehicle must have

p)      Section 94 - Crank case gases

q)      Section 99 - Exhaust systems

 

 

10.   Conditions - Dimensions (Width and Side Projection)

 

Maximum width for a Christmas pageant float operating under this Notice is 4.9m, including any side projection.

 

11.   Condition - Speed restriction

 

A Christmas pageant float operating under this notice must not exceed 25kph.

 

12.   Conditions - Stated routes

 

A Christmas pageant float complying with the requirements of this Notice may operate on the Adelaide Christmas Pageant Route, as amended from time to time.

Note -  The Adelaide Christmas Pageant Route is maintained and published by the South Australia Department of Planning, Transport and Infrastructure (DPTI), and is available on the department’s website. The route may be updated from time to time by DPTI.

13.   Condition – Escort provisions

All movements by a Christmas pageant float under this Notice must be undertaken under the supervision and direction of police escort

 

14.   Condition – Times of travel

Operation under this Notice is restricted to the hours between sunrise and sunset on the day of the Adelaide Christmas Pageant.
