HEAVY VEHICLE NATIONAL LAW

 

QUEENSLAND HEAVY VEHICLE STANDARDS (SAPPHIRE MINING INDUSTRY) EXEMPTION NOTICE 2016 (No.1)

 

  1. Purpose

 

The purpose of this Notice is to exempt unregistered sapphire mining vehicles used on roads situated on unallocated State land within the Emerald Shire from certain vehicle standards.

 

2.       Authorising Provision

 

This Notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in Queensland.

 

3.       Title

 

This Notice may be cited as the Queensland Heavy Vehicle Standards (Sapphire Mining Industry) Exemption Notice 2016 (No.1).

 

4.       Commencement

 

This Notice commences on 1 July 2016.

 

5.       Expiry

 

This notice expires on 30 June 2019.

 

6.       Definition

 

In this notice

 

Eligible vehicle means an unregistered heavy vehicle operated by a miner associated with the Queensland Sapphire Mining Association.

 

 

7.       Application

 

This Notice applies to an eligible vehicle in Queensland.

 

8.       Areas or routes to which this Notice applies

 

This Notice applies to all roads on unallocated State land within the Emerald Shire.

 

 

 

 

 

 

9.       Exemptions from prescribed vehicle standards

 

(1)    An eligible vehicle to which this Notice applies is exempt from complying with the following requirements of Schedule 2 of the Heavy Vehicle (Vehicle Standards) National Regulation -

(a)    Division 2 - General requirements for lights;

(b)    Division 3 - Headlights;

(c)     Division 4 – Parking lights;

(d)    Division 6 – Tail lights;

(e)    Division 7 – Number plate lights;

(f)     Section 52 - Front clearance lights;

(g)    Section 54 – Rear clearance lights;

(h)    Division 9 – Side marker lights.

 

 

10.   Conditions

 

(1)    An eligible vehicle must be operated –

 

(a)    during daylight hours; and

(b)    on, or for the purposes of maintaining, roads situated on unallocated State land within the Emerald Shire.
