Queensland Heavy Vehicle Standards (Conditional Registration) Exemption Notice 2019 (No. 1)

 

1.         Purpose

The purpose of this notice is to exempt a heavy vehicle to which it applies from certain requirements of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).

 

Note: This notice is not an access authority. For a vehicle to operate under this notice a vehicle must already be eligible for access to the road network under the heavy Vehicle National Law or, in the case of a restricted access vehicle, under a Class 1, 2 or 3 authority or a HML declaration. Reference to “access” in this Notice or any of the documents it refers only so far as access already authorised under the HVNL or an access authority.

2.         Authorising Provision

This notice is made under section 61 of the Heavy Vehicle National Law (HVNL) as in force in Queensland.

 

3.         Title

This notice may be cited as the Queensland Heavy Vehicle Standards (Conditional Registration) Exemption Notice 2019 (No. 1).

 

4.         Commencement

This notice commences on 23 September 2019.

 

5.         Expiry

This notice expires 22 September 2024.

 

6.         Definitions

(1)                Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the HVNL.

 

(2)                In this notice:

 

Conditional Registration means conditional registration in Queensland pursuant to the requirements of the Guideline for Conditionally Registered Vehicles in Queensland.

 

Queensland Guideline means the Guideline for Conditionally Registered Vehicles in Queensland, approved by the Chief Executive of the Department of Transport and Main Roads (Queensland) or his delegate, as amended from time to time.

7.         Application

(1)    This Notice applies only in Queensland.

 

(2)    This notice applies to heavy vehicles that are registered in accordance with the Queensland Guideline.

 

8.         Exemption from Prescribed Vehicle Standards

A heavy vehicle, described in s7(2) is exempt from complying with the requirements of Schedule 2 of the National Regulation to the extent listed in section 7 of the Queensland Guideline.

 

9.         Conditions

A heavy vehicle operating under this notice must comply with all the conditions imposed by the Queensland Guideline.
