This Notice was introduced to extend the operational period of the Class Permit 147-TH-14 Log Timber Concession, originally published by the Queensland Department of Transport and Main Roads on 7 February 2014, thereby providing additional time for compliance and operations within the specified legal framework. This Amendment Notice is made under Section 23 of Schedule 1 of the Heavy Vehicle National Law and was issued by the National Heavy Vehicle Regulator, with Peter Caprioli as the Executive Director Access. The policy objective of this amendment is to ensure that the operations associated with log timber concessions under the Heavy Vehicle National Law can continue without interruption, thereby maintaining regulatory compliance and operational efficiency.
Scope and Application
This Amendment Notice pertains to the Heavy Vehicle National Law in Queensland, specifically targeting the Class Permit 147-TH-14 Log Timber Concession, which was initially published by the Queensland Department of Transport and Main Roads on 7 February 2014. The Notice extends the operational period of the permit, originally set to expire on 31 December 2018, to 31 December 2019. It applies to entities involved in the logging and transportation of timber, ensuring they comply with the heavy vehicle regulations set forth under the National Law. This legislative amendment is made under Section 23 of Schedule 1 of the Heavy Vehicle National Law, thereby enforcing its provisions nationwide. The Notice does not introduce any new exclusions or exemptions but rather modifies the timeframe for the permit, thereby extending its applicability without altering other aspects of its original scope.
Key Provisions
The Heavy Vehicle National Law Queensland - Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2018 (No. 1) is designed to extend the operation of a previous Notice issued under a former corresponding law for the Heavy Vehicle National Law. This amendment specifically concerns the Class Permit 147-TH-14 Log Timber Concession, originally published by the Queensland Department of Transport and Main Roads on 7 February 2014. The Notice aims to adjust the operational timeframe of this permit, as outlined in Clause 1.1, by extending the expiration date from 31 December 2018 to 31 December 2019.
This legislation imposes certain obligations and requirements on the parties and entities it governs. Primarily, it requires that the amended permit, which now extends to 31 December 2019, is adhered to by all relevant parties, including those involved in the transportation of heavy vehicles engaged in logging timber under the specified permit. The Notice ensures that the updated timeframe is clearly communicated and understood, thereby maintaining compliance with the new operational period.
In terms of consequences for non-compliance, the Notice does not explicitly outline specific offences or penalties within its text. However, breaches of the Heavy Vehicle National Law or any related permits can typically result in serious consequences, including fines, vehicle impoundment, and potential legal action. The exact penalties would depend on the specific nature and severity of the breach, and would be in line with the broader provisions of the Heavy Vehicle National Law. The Notice operates under the authority granted by Section 23 of Schedule 1 of the Heavy Vehicle National Law, which allows for such amendments to ensure the continued safety and efficiency of heavy vehicle operations in Queensland.
