Overview
The Heavy Vehicle National Law, enacted in 2012, is designed to create a uniform regulatory framework for heavy vehicles across Australia, aiming to ensure the safety, efficiency, and environmental protection in the transportation sector. The Heavy Vehicle National Law (Queensland - Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2017 (No. 1)) was introduced to address the need for updating and extending the operational timelines of certain permits and concessions, ensuring continued compliance and facilitation of the timber logging industry under the new regulatory regime. This legislative amendment is made under the authority of the National Heavy Vehicle Regulator, reflecting the policy objective of maintaining operational continuity and adapting to changing industry needs while upholding safety standards.
Scope and Application
This Amendment Notice, issued under Section 23 of Schedule 1 of the Heavy Vehicle National Law, extends the operation of a previously issued Notice related to the Heavy Vehicle National Law. Specifically, the Notice pertains to the Class Permit 147-TH-14 Log Timber Concession published by the Queensland Department of Transport and Main Roads on 7 February 2014. The primary amendment involves extending the expiration date of Clause 1.1 from 31 December 2017 to 31 December 2018. This extension applies to the permit issued for the transportation of log timber in Queensland, thereby affecting the logistics and operations of entities involved in log timber transport within the state. The Notice operates from the date of its publication in the Commonwealth Gazette and is applicable to all entities holding the Class Permit 147-TH-14 Log Timber Concession in Queensland. The amendment does not specify any exclusions, exemptions, or thresholds, nor does it detail any extensions or restrictions through subordinate instruments.
Key Provisions
The main operative sections of the Heavy Vehicle National LawQueensland - Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2017 (No. 1) primarily focus on the extension of a permit related to the transportation of log timber within Queensland. Specifically, Clause 1.1, which originally stipulated that the permit would expire on 31 December 2017, has been amended to extend its validity until 31 December 2018 (Section 5(1)(a)). This amendment ensures that the conditions under which heavy vehicles are permitted to transport log timber continue to apply for an additional year.
The obligations imposed by this legislation on the parties involved, particularly those operating under the Class Permit 147-TH-14 Log Timber Concession, include adherence to the extended timeline set out in the amended Clause 1.1. Operators must ensure that their activities comply with the updated permit conditions, which now allow for operations up until the end of the year 2018. This involves maintaining any necessary documentation and ensuring that their vehicles and operations are in line with the stipulations of the Heavy Vehicle National Law and any relevant state regulations.
Failure to comply with the provisions of this Notice may result in civil or criminal consequences, although the specific penalties are not detailed within the text. Generally, breaches of the Heavy Vehicle National Law can lead to fines, suspension or revocation of permits, and other regulatory actions. The severity of the penalties will depend on the nature and extent of the breach, with the potential for significant financial and operational repercussions for those found in violation of the law.
