Overview

The Heavy Vehicle National Law Queensland - Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2016 (No. 3) was enacted to address a temporary operational extension of a permit issued under a former corresponding law for the Heavy Vehicle National Law. This legislation was developed to ensure a seamless continuation of permit operations related to the transportation of log timber, facilitating compliance and reducing disruptions in operations for affected parties. The Notice was authorised under Section 23 of Schedule 1 of the Heavy Vehicle National Law, reflecting the legislative intent to harmonise heavy vehicle regulations across Australia. The primary purpose of this amendment was to extend the operational period of the specified log timber concession permit from 31 December 2016 to 31 December 2017, ensuring that stakeholders could continue their activities without interruption. This amendment was made by the National Heavy Vehicle Regulator, an entity established to oversee and enforce heavy vehicle regulations nationwide. The policy objective behind this amendment was to provide a temporary solution to operational needs, maintaining the balance between regulatory compliance and practical operational requirements. This approach underscores the legislative intent to support the efficient functioning of the heavy vehicle industry while adhering to national safety and operational standards.

Scope and Application

The Queensland Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2016 (No. 3) pertains to the temporary extension of a notice issued under a former corresponding law for the Heavy Vehicle National Law. This Notice is applicable to entities and persons operating heavy vehicles involved in the logging and transportation of timber under the specified Class Permit. Its jurisdictional reach extends within Queensland, specifically governed by the provisions of the Heavy Vehicle National Law. The primary amendment involves extending the operational period of the permit from 31 December 2016 to 31 December 2017. This extension is authorised under Section 23 of Schedule 1 of the Heavy Vehicle National Law and applies directly to the amended permit published by the Queensland Department of Transport and Main Roads on 7 February 2014. The Notice does not explicitly state any exclusions, exemptions, or thresholds, but the specific nature of its application is confined to the logging timber industry within Queensland. The Notice is effective from the date of its publication in the Commonwealth Gazette.

Key Provisions

The primary operative sections of the Heavy Vehicle National Law Queensland - Class Permit 147-TH-14 Log Timber Concession Amendment Notice 2016 (No. 3) (referred to as the Notice) involve the temporary extension of a previously issued Notice under the Heavy Vehicle National Law (section 23 of Schedule 1). This Notice specifically pertains to the Class Permit 147-TH-14 Log Timber Concession, which was originally published by the Queensland Department of Transport and Main Roads on 7 February 2014. The Notice amends Clause 1.1 by extending the operational period of the Class Permit from 31 December 2016 to 31 December 2017 (clause 5(1)(a)). This amendment allows the permit to continue in effect for an additional year, providing a temporary extension to the original timeframe. The Notice imposes specific obligations and requirements on the parties governed by it, particularly those holding or applying for the Class Permit 147-TH-14 Log Timber Concession. The most notable obligation is the compliance with the amended operational period, which now extends until 31 December 2017. Parties must adhere to this extended period to remain compliant with the law. Additionally, there may be other requirements or conditions stipulated in the original permit or related legislation that continue to apply, such as safety standards, vehicle specifications, and any other regulatory conditions set forth by the Queensland Department of Transport and Main Roads. In terms of offences, penalties, or consequences for breach, the Notice itself does not explicitly state penalties or criminal consequences. However, any breach of the conditions stipulated in the amended permit, or any related heavy vehicle legislation, may result in penalties as prescribed under the Heavy Vehicle National Law or other relevant Queensland laws. These penalties could include fines, licence suspension, or other administrative actions. The specific penalties would depend on the nature and severity of the breach, as outlined in the broader legislative framework governing heavy vehicle operations in Queensland. The Notice is designed to ensure that the temporary extension does not disrupt the operations of those holding the Class Permit 147-TH-14 Log Timber Concession, allowing them to continue their activities under the amended terms until the specified end date. This amendment provides clarity and certainty to permit holders, enabling them to plan and operate within the extended timeframe without the need for additional applications or approvals during this period.
