Queensland Class 3 Heavy Vehicle (Indivisible Item) Dimension Exemption Notice 2019 (No.1)

1. Purpose

This Notice provides dimension exemptions that allow specified Heavy Vehicles to carry large indivisible items.

Note:-  this Notice replaces elements of the Queensland Guideline for Excess Dimension - Vehicles Carrying Indivisible Articles, Special Purpose Vehicles, Vehicles that require a Pilot or Escort in Queensland, Form 4.

2.       Definitions

Access Conditions Guide means the Queensland Access Conditions Guide published by TMR that contains further specific information referenced in this Schedule.

Built up area has the same meaning as in the Access Conditions Guide

Eligible vehicle means a heavy vehicle that exceeds prescribed dimension requirements when loaded with one or more indivisible items, and is a:

a)      A B-double; or

b)      A road train; or

c)       A truck and dog trailer combination exceeding 19m in length but not more than 31.5m that complies with the Queensland Class 3 Truck and Dog Notice.

Large Indivisible Item has the same meaning as in s116 of the HVNL.

Pilot and Escort Guideline means the Guideline for Pilot and Escort Operations in Queensland published by TMR that contains further specific information referenced in this Schedule.

Truck and dog means, for the purpose of this Notice only, a Type 1 Road Train.

Type 1 Road Train for the purpose of this Notice:

a)      has the same meaning as in the Queensland Schedule of the National Class 2 Road Train Notice; or

b)      is a truck and dog trailer combination exceeding 19m in length but not more than 31.5m that complies with the Queensland Class 3 Truck and Dog Notice.

Type 2 Road Train has the same meaning as in the Queensland Schedule of the National Class 2 Road Train Notice.

TMR means the Queensland Department of Transport and Main Roads.

TMR Excess Mass and Conditions means the route and area conditions, and including the Conditions of Operation Database, maintained and published by TMR.

3.       Application

1)      This notice applies to an eligible vehicle operating in Queensland.

4.       Exemptions

1)      This Notice exempts eligible vehicles from the following dimension requirements in Schedule 6 of the Heavy Vehicle (Mass Dimension & Loading) National Regulation:

a)      Section 7

b)      Section 8(d).

5.       Condition – Dimensions

1)      An eligible vehicle operating under this notice must comply with the following dimension conditions:

a)      Eligible vehicles up to 2.5m wide may be up to 4.8m high.

b)      Eligible vehicles up to 3.2m wide may be up to 4.6 m high.

2)      In addition to the conditional dimensions above, eligible vehicles travelling on the Barkly Highway between the Queensland/Northern Territory border and Camooweal may use the following conditional dimensions:

a)      Type 1 road trains up to 3.5m wide and 4.85m high; and

b)      Type 2 road trains up to 3.2m wide and 4.85m high.

3)      A Type 2 road train travelling on the Barkly Highway, between Cloncurry and Mt Isa

may only carry an indivisible article wider than 2.5m to a width of 3.2m on the first

trailer of the combination or in instances of a truck and trailer road train combination, the truck only.

6.       Conditions – Approved Routes

1)      An eligible vehicle operating under a mass exemption of this Notice may operate on the routes specified in Table 1 when loaded with large indivisible items and travelling on particular routes. An eligible vehicle listed in Column 1 must load indivisible items as per Column 2 when operating on the routes listed in Column 3.

7.       Conditions – General Cargo

1)      An eligible vehicle or combination may carry general cargo at the same time as an indivisible item provided:

a)      the vehicle combination and its load complies with the mass limits in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation; and

b)      the loading space required for the general cargo does not exceed a dimension limit in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

8.       Conditions - Pilots and escorts

1)      A pilot or escort vehicle assisting an eligible vehicle operating under this Notice must comply with the Pilot and Escort Guideline as it relates to Load Carrying Vehicles.

2)      In addition to the pilot and escort requirements above, the following special requirements apply on the Warrego Highway between Toowoomba and the Chinchilla Shire boundary for vehicles operating under this Notice:

a)      A Type 1 road train or B-double combination carrying indivisible articles wider than 2.5m to a width of 3.2m on all trailers or truck and trailer of a truck and trailer road train, must be accompanied by one pilot vehicle in accordance with the conditions specified in the Pilot and Escort Guideline when travelling on the Warrego Highway between Toowoomba and the Chinchilla Shire boundary (approximately 3km north west of Warra).

3)      Vehicles operating in accordance with 2) are exempt from the requirement of being accompanied by a pilot vehicle if an large indivisible article is being carried on only the first trailer of the combination, or in instances of a rigid truck and trailer road train combination, the truck only.

9.       Conditions – Application of Schedule 8 of the MDL Regulation

1)      The following sections of Schedule 8 of the MDL Regulation apply to eligible vehicles operating under this Notice:

a)       Division 1 General conditions

b)       Division 2 sections 12 and 13.

Note: Specifically, this is an application for the Class 1 conditions in Schedule 8 to a Class 3 vehicles under this Notice.
