Overview

The Queensland Agricultural Machines and Cane Bins Flotation Tyres Mass Exemption Notice 2017 (No. 1) was introduced to address the need for flexibility in the operation of agricultural machines and cane bin trailers with flotation tyres, particularly in Queensland where these vehicles are crucial for agricultural activities. This exemption notice, which is a statutory instrument, was enacted by the National Heavy Vehicle Regulator under section 117 of the Heavy Vehicle National Law. It allows these vehicles to operate within certain mass and operational parameters while being exempt from certain provisions of the Heavy Vehicle National (Mass Dimension and Loading) National Regulation. The notice specifies mass limits for different axle configurations and requires compliance with tyre load pressures, among other conditions, to ensure safety and operational standards are maintained. The notice came into effect on 1 July 2017 and is set to expire on 30 June 2022, providing a temporary regulatory framework that aims to balance operational needs with safety considerations.

Scope and Application

The Queensland Agricultural Machines and Cane Bins Flotation Tyres Mass Exemption Notice 2017 (No. 1) applies specifically to eligible vehicles in Queensland, namely agricultural machines and cane bin trailers that are used for agricultural purposes. This exemption notice, which is made under section 117 of the Heavy Vehicle National Law, is designed to allow these vehicles to operate on roads under certain conditions and within specified parameters. The notice exempts such vehicles from certain limits set out in the Heavy Vehicle National (Mass Dimension and Loading) National Regulation, but only while they are being used for agricultural activities within Queensland. There are specific conditions attached to the exemption, including mass limits for different types of axle groups, adherence to the manufacturer’s specified gross trailer mass, and requirements for vehicles with higher mass or speed capabilities to be fitted with dampened load sharing suspension and air brakes. Furthermore, the notice mandates compliance with tyre load and pressure limits, and requires that a copy of the notice be carried in the vehicle at all times. This exemption notice is in effect from 1 July 2017 and will expire on 30 June 2022, unless otherwise altered through subordinate instruments.

Key Provisions

The Queensland Agricultural Machines and Cane Bins Flotation Tyres Mass Exemption Notice 2017 (No. 1) primarily concerns agricultural machines and cane bin trailers equipped with flotation tyres. It provides a framework for these vehicles to operate on roads in Queensland under specific conditions. This notice exempts such vehicles from certain mass and dimension limits stipulated in the Heavy Vehicle National (Mass Dimension and Loading) National Regulation (section 8). The notice applies to eligible vehicles in Queensland when they are used for agricultural purposes (section 7). Under the notice, there are several key obligations that the vehicles must adhere to. These include mass limits where the gross trailer mass should not exceed 11t for a single axle group, 20t for a tandem axle group, or 28t for a triaxle group (section 9.1). Additionally, the vehicle must not exceed the manufacturer’s specified gross trailer mass (section 9.2). Vehicles with axle groups weighing 20t or more, or with a speed capability greater than 50kph, must be equipped with dampened load sharing suspension and air brakes (section 9.3). Compliance with tyre load and pressure limits is also mandatory, with specific tyre pressures provided in the notice (section 9.4). Furthermore, a copy of the notice must be carried in the vehicle at all times while operating under its provisions (section 9.5). Failure to comply with the provisions of this notice can result in significant consequences. While the specific offences, penalties, or civil and criminal consequences for breach are not detailed in the notice, it is reasonable to infer that breaches of the Heavy Vehicle National Law or its regulations could lead to penalties as prescribed under the law. For instance, breaches of the Heavy Vehicle National Law can result in both civil and criminal penalties, including fines and potential imprisonment, depending on the severity and nature of the breach. The maximum penalties under the Heavy Vehicle National Law can be severe, with fines up to thousands of dollars and imprisonment for several years for more serious offences.
