Overview

The New South Wales Class 3 Port Botany Freight Container Exemption Notice 2019 (No. 1) was enacted to address the need for more efficient transport of freight containers within the Greater Sydney area by providing exemptions from certain mass requirements for eligible heavy vehicles. This Notice, made under section 117 of the Heavy Vehicle National Law (HVNL), aims to streamline operations for vehicles transporting freight containers to and from designated stevedore’s terminals, thereby enhancing the efficiency of container transportation within the region. It operates in conjunction with the New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2019 Operator’s Guide, which provides detailed information on routes and other operational requirements. This exemption allows eligible vehicles to operate under specific mass limits while ensuring safety and compliance with other regulatory requirements.

Scope and Application

The New South Wales Class 3 Port Botany Freight Container Exemption Notice 2019 provides an exemption from prescribed mass requirements for eligible heavy vehicles transporting freight containers within the Greater Sydney area. This Notice applies specifically to vehicles carrying one or more shipping containers to or from a Prescribed Stevedore’s Terminal, and includes rigid trucks, prime mover and semi-trailer combinations with an overall length not exceeding 19 metres, and B-doubles with an overall length not exceeding 26 metres. Notably, truck and dog trailer combinations, and truck and pig trailer combinations, are excluded from the scope of this Notice. The exemption applies to specified mass limits for a single vehicle or combination, single axle or axle group, and axle spacing, provided that the vehicle adheres to the conditional upper mass limits specified in Table 1 of the Notice. Eligible vehicles must also comply with the approved routes outlined in the New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2019 Operator’s Guide, as well as certain safety requirements including the installation of lane departure warning systems, emergency braking systems, and electronic stability control systems. This Notice is made under section 117 of the Heavy Vehicle National Law and operates in conjunction with the Operator’s Guide published by the National Heavy Vehicle Regulator.

Key Provisions

The New South Wales Class 3 Port Botany Freight Container Exemption Notice 2019 (No. 1) exempts certain heavy vehicles transporting freight containers within the Greater Sydney area from prescribed mass requirements, provided they meet specific conditions. Eligible vehicles include rigid trucks, prime mover and semi-trailer combinations with an overall length not exceeding 19 metres, and B-doubles with an overall length not exceeding 26 metres. These vehicles are exempt from prescribed mass requirements corresponding to their type in Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (section 8). However, they must adhere to conditional upper mass limits specified in Table 1 of the Notice, which are the same as those for Concessional Mass Limits (CML) as set out in Schedule 2 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. Notably, vehicles operating under this Notice must comply with specific conditions, including adhering to approved routes and areas as set out in the New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2019 Operator’s Guide (section 10). Additionally, eligible vehicles must be enrolled in and compliant with the Road Infrastructure Management (RIM) application, which is a certified Intelligent Application Program maintained by the Transport Certification Australia (TCA) (section 11). Furthermore, these vehicles must be fitted with safety systems compliant with relevant Australian Design Rules, including lane departure warning systems, emergency braking systems, vehicle braking systems, electronic stability control systems, and trailer braking systems for combinations (section 12). The Notice imposes several obligations on the parties or entities it governs. Firstly, eligible vehicles must comply with the conditional upper mass limits specified in Table 1 of the Notice. Secondly, they must operate only on the approved routes and areas outlined in the New South Wales Class 3 Port Botany Container Transportation Mass Exemption Notice 2019 Operator’s Guide. Thirdly, these vehicles must be enrolled in and compliant with the Road Infrastructure Management (RIM) application. Finally, eligible vehicles must be equipped with specific safety systems as outlined in section 12 of the Notice. Failure to comply with any of these obligations may result in legal consequences. Breaches of the conditions set out in the Notice may result in civil or criminal consequences. While the Notice does not specify maximum penalties for breaches, violations of heavy vehicle regulations generally attract significant fines. For example, contravening the Heavy Vehicle National Law can result in fines of up to $11,100 for individuals and $55,500 for corporations, with higher penalties for repeat offences. Additionally, repeated or serious breaches may lead to the suspension or revocation of the vehicle operator's licence, resulting in the cessation of operations. Therefore, compliance with the Notice is crucial to avoid these severe consequences.
