Overview

The New South Wales Class 3 Livestock Transportation Exemption Notice 2020, enacted under section 117 of the Heavy Vehicle National Law, was introduced to provide mass exemptions supporting the New South Wales Livestock Loading Scheme. The Notice revokes and replaces the New South Wales Class 3 Livestock Transportation Exemption Notice 2019 (No.1) and aims to streamline the transportation of livestock by setting specific conditions and exemptions for eligible heavy vehicle combinations operating within New South Wales. The Notice is in effect from 8 October 2020 until 9 February 2024 and applies to eligible combinations transporting livestock. Compliance with the New South Wales Livestock Loading Scheme is mandatory, which includes adherence to road and travel conditions, deck requirements, driver accreditation, registration, and interstate mutual recognition requirements. The Notice also outlines vehicle requirements and mass limitations, including specific conditions for road-friendly suspension and the use of certified telematics applications for certain vehicle types. The policy objective of this Notice is to facilitate the efficient and compliant transportation of livestock in New South Wales while ensuring road safety and compliance with the state's livestock loading regulations. By providing specific exemptions and conditions, the Notice aims to reduce administrative burdens on operators while maintaining high standards of safety and compliance.

Scope and Application

The New South Wales Class 3 Livestock Transportation Exemption Notice 2020 applies to eligible heavy vehicle combinations operating in New South Wales while transporting livestock. These combinations include single articulated vehicles, B-doubles, road trains, B-triples, and AB-triples, each with specified loading space and length limitations. The Notice operates under the authority of section 117 of the Heavy Vehicle National Law and serves to provide mass exemptions to these vehicles in accordance with the New South Wales Livestock Loading Scheme, replacing the 2019 version of the Notice. The Notice exempts eligible combinations from certain mass requirements outlined in the Heavy Vehicle (Mass, Dimension & Loading) National Regulation, provided the vehicles meet specified conditions such as axle configurations and suspension requirements. Compliance with the New South Wales Livestock Loading Scheme is mandatory for vehicles operating under this Notice, and certain combinations must also comply with intelligent access conditions, including enrolment in specified telematics programs. The Notice is in effect from 8 October 2020 until 9 February 2024. The scope of the Notice extends to defining the parameters for eligible combinations and their operational limitations within specific networks as outlined in the New South Wales Livestock Loading Scheme. The Notice does not explicitly detail subordinate instruments but indicates that further conditions and requirements are provided by the New South Wales Livestock Loading Scheme and the New South Wales Higher Mass Limits Declaration 2020. The exemptions and conditions provided by this Notice aim to facilitate the efficient and compliant transportation of livestock across New South Wales.

Key Provisions

The New South Wales Class 3 Livestock Transportation Exemption Notice 2020 (No.1) outlines the main provisions of mass exemptions to support the New South Wales Livestock Loading Scheme, providing exemptions from certain mass requirements under the Heavy Vehicle (Mass, Dimension & Loading) National Regulation (MDL Regulation) (sections 1, 10). Eligible combinations, as defined in section 8, are those heavy vehicle combinations that meet the specified categories and are transporting livestock. These vehicles must comply with several conditions, including vehicle requirements such as having a prime mover with a tandem axle drive group, semi-trailers with tandem axle or tri-axle groups, and certified road-friendly suspension fitted and maintained in working order on all axle groups of all semi-trailers (section 9). The Notice also sets out specific mass requirements and limits, including gross combination mass (GCM) limits (section 11), axle and axle group mass limits (section 12), and mass limits related to axle spacing (section 13). Additionally, eligible combinations must adhere to stated areas and routes as specified in the New South Wales Livestock Loading Scheme, and B-triples and AB-triples must be enrolled in either the Telematics Monitoring Application (TMA) with Transport Certification Australia (TCA) or the Intelligent Access Program (IAP) with Transport for New South Wales (TfNSW) (sections 14, 15). Compliance with the New South Wales Livestock Loading Scheme and its conditions, including livestock eligibility, deck requirements, driver accreditation, registration, and interstate mutual recognition requirements, is also mandatory (section 16). The New South Wales Class 3 Livestock Transportation Exemption Notice 2020 imposes several obligations on parties and entities it governs. Eligible combinations must adhere to the vehicle requirements outlined in section 9, including having the specified axle groups and certified road-friendly suspension. Mass requirements and limits are also imposed, as detailed in sections 11, 12, and 13. Operators must ensure their vehicles comply with these mass limits to avoid penalties. Additionally, the Notice mandates compliance with the New South Wales Livestock Loading Scheme and its conditions, including livestock eligibility, deck requirements, driver accreditation, registration, and interstate mutual recognition requirements (section 16). B-triples and AB-triples must also be enrolled in either the TMA with TCA or the IAP with TfNSW (section 15). Breaches of the New South Wales Class 3 Livestock Transportation Exemption Notice 2020 may result in various civil or criminal consequences, although specific penalties are not outlined in the text. Violations of the mass requirements and limits set out in sections 11, 12, and 13 could potentially lead to fines or other penalties as stipulated by the MDL Regulation. Non-compliance with the vehicle requirements in section 9, or failure to adhere to the New South Wales Livestock Loading Scheme and its conditions (section 16), may also result in penalties. Furthermore, operating a vehicle without the required enrolment in the TMA with TCA or IAP with TfNSW (section 15) could lead to enforcement actions by the relevant authorities.
