New South Wales Class 3 Heavy Vehicle Rear Overhang Limit Dimension Exemption Notice 2019 (No. 1)
Purpose
- The purpose of this notice is to exempt stated class 3 heavy vehicles from the rear overhang length limits set out in section 5 of Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation and to specify the conditions of the exemption under this notice.
Note— This Notice replaces the New South Wales Class 3 Heavy Vehicle Rear Overhang Limit Dimension Exemption (Notice) 2014 (No. 1).
Authorising Provision
2. This notice is issued in accordance with section 117 of the Heavy Vehicle National Law (HVNL) as in force in each participating jurisdiction.
Title
3. This notice may be cited as the New South Wales Class 3 Heavy Vehicle Rear Overhang Limit Dimension Exemption Notice 2019.
Commencement
4. This notice commences on 10 February 2019.
Expiry
5. This notice expires on 9 February 2024.
Definitions
6. Unless otherwise stated, words and expressions used in this notice have the same meaning as in the Heavy Vehicle National Law.
Application
7. This notice applies to a truck or trailer that exceeds 9.5m in length, excluding any load, and that has a forklift truck attached to the rear of the truck or trailer for the sole purpose of loading and unloading goods on and off the truck or trailer.
8. This notice applies in New South Wales.
Conditions
9. The rear overhang of the truck or trailer (including the forklift truck) must not exceed 4.0m.
10. Any forklift truck attached to the rear of a truck or trailer may project more than 1.2 metres to the rear of the truck or trailer if there is—
(a) During the daytime – a brightly coloured red, red and yellow or yellow flag at least 300 mm by 300 mm is fixed to the extreme back of the load; or
(b) At night – a light showing a clear red light to the back, visible at a distance of at least 200 m, is fixed to the extreme back of the load.
11. A number plate must be clearly visible from the rear of the truck or trailer at all times—
(a) If the number plate on the rear of the truck or trailer is obscured by the fork lift truck, and the fork lift truck is conditionally registered, the number plate of the fork lift truck must be clearly visible from the rear of the vehicle.
(b) If the number plate on the rear of the truck or trailer is obscured by the fork lift truck and the fork lift truck is not conditionally registered, the number plate of the truck or trailer must be relocated so that it is clearly visible from the rear of the vehicle.
Condition – Areas or Routes
12. The truck or trailer may operate on all roads in New South Wales that are approved under the HVNL for the operation of the truck, or for the operation of the combination that includes the trailer, except where prohibited by a load limit specified for a road, bridge or causeway by a sign or notice.
