Overview
The Heavy Vehicle National Law New South Wales Class 1 Special Purpose Vehicles Notice Amendment Notice 2016 (No. 1) was enacted to make minor amendments to the Class 1 Special Purpose Vehicles Notice 2014, addressing specific technical aspects of vehicle regulations. This amendment was necessary to correct and update certain overmass limits relating to tyre width and to adjust the classification of a specific road segment in Sydney. This Notice was made under Section 117, and Section 23 of Schedule 1, of the Heavy Vehicle National Law, by the National Heavy Vehicle Regulator. The policy objective of this legislative amendment is to ensure that vehicle regulations remain accurate and relevant, thereby enhancing road safety and compliance with national heavy vehicle standards.
This amendment notice, which comes into effect on 3 June 2016 and expires on 6 February 2019, modifies the overmass limits in Table 3 of Part 4 of the Schedule and updates the classification of a specific road segment in Sydney North. These changes aim to ensure that the regulations are clear, precise, and effective in managing the operation of special purpose vehicles within the state of New South Wales.
Scope and Application
The Heavy Vehicle National Law New South Wales Class 1 Special Purpose Vehicles Notice Amendment Notice 2016 (No. 1) applies to Class 1 special purpose vehicles within the state of New South Wales, specifically targeting entities and individuals operating such vehicles. This Notice is an amendment to the Class 1 Special Purpose Vehicles Notice 2014, thereby affecting the overmass limits relating to tyre width and the definition of limited access locations. The amendment comes into effect on 3 June 2016 and remains in force until 6 February 2019. It provides specific modifications to the overmass limits for tyre widths and alters the definition of limited access locations in Sydney North, impacting the operational parameters for vehicles in these categories. The Notice is crafted under the authority of Sections 117 and 23 of Schedule 1 of the Heavy Vehicle National Law, and its scope is strictly within the jurisdictional boundaries of New South Wales.
Key Provisions
The Heavy Vehicle National Law New South Wales Class 1 Special Purpose Vehicles Notice Amendment Notice 2016 (No. 1) amends the Class 1 Special Purpose Vehicles Notice 2014. Specifically, it makes adjustments to the overmass limits relating to tyre width (section 5(1)(a) and (b)) and modifies the definition of limited access locations in Sydney North (section 5(2)(a) and (b)). These amendments reflect updated requirements and operational parameters for Class 1 special purpose vehicles in New South Wales.
The obligations imposed by this Amendment Notice include ensuring compliance with the revised overmass limits specified for vehicles with certain tyre widths. For instance, vehicles with tyres at least 330mm but less than 356mm in width must now adhere to an overmass limit of 7.5, and those with tyres at least 356mm but less than 381mm in width must comply with an overmass limit of 8.0 (section 5(1)(a) and (b)). Additionally, the Notice updates the list of limited access locations in Sydney North, removing the previous entry for the M2 Motorway and tunnel from the toll plaza at Macquarie Park to Beecroft Road (MR139) and inserting a new entry with adjusted forward projection limits (section 5(2)(a) and (b)).
Failure to comply with the provisions set out in this Amendment Notice could lead to legal consequences. Although the Notice itself does not explicitly outline specific offences, penalties, or consequences for non-compliance, breaches of the Heavy Vehicle National Law or associated regulations could result in enforcement actions under the broader legislative framework. Such actions might include fines, vehicle impoundment, or other administrative penalties as prescribed by the overarching legislation. The exact penalties would be determined by the relevant authorities in accordance with the provisions of the Heavy Vehicle National Law and related regulations.
