Overview
The New South Wales and Victoria Class 3 Long Livestock Semitrailer Deck Length Exemption Notice 2019 (No.1) was enacted to address the need for increased flexibility in the transportation of livestock via semitrailers, specifically allowing for longer deck lengths than what is typically prescribed. This Notice was introduced to exempt certain semitrailers used for livestock transportation from the deck length limitations set out in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. Authorised under section 117 of the Heavy Vehicle National Law and section 69(1)(a) of the Heavy Vehicle (General) National Regulation, it aims to facilitate more efficient livestock transport while maintaining safety and compliance with other regulatory requirements. The Notice came into effect on 10 February 2019 and will remain in force until 9 February 2024, providing a temporary exemption specifically for long livestock semitrailers in New South Wales and Victoria, subject to certain conditions including limitations on the number of decks and types of livestock that can be carried.
Scope and Application
The Heavy Vehicle National Law New South Wales and Victoria Class 3 Long Livestock Semitrailer Deck Length Exemption Notice 2019 exempts long livestock semitrailers from certain dimensional requirements specified in the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. This Notice applies to semitrailers with a maximum length of 14.6 metres and a distance from the front articulation point to the rear of the semitrailer that does not exceed 13.2m, used for carrying livestock. Notably, this exemption is geographically limited to New South Wales and Victoria. It does not exempt these vehicles from other requirements of the Heavy Vehicle National Law, including mass and other dimension requirements. The exemption comes with specific conditions: the semitrailer may only be used in a combination consisting of a prime mover towing a single semitrailer, must not have more than two decks, must not carry cattle on more than one deck, and the deck length available for the carriage of livestock must not exceed the total length of the semitrailer. Additionally, the lower deck of the semitrailer must be fully loaded before the upper deck is used. The Notice also specifies that the driver and operator of the vehicle must comply with all conditions set out in the Schedules for New South Wales and Victoria when the vehicle is being used in the respective jurisdictions. This exemption is effective from 10 February 2019 and will expire on 9 February 2024.
Key Provisions
The New South Wales and Victoria Class 3 Long Livestock Semitrailer Deck Length Exemption Notice 2019 (No. 1) is a legislative instrument designed to exempt certain semitrailers from specific dimension requirements under the Heavy Vehicle National Law. This Notice specifically targets semitrailers used to transport livestock, allowing for a longer deck length than otherwise permitted under the Heavy Vehicle (Mass, Dimension and Loading) National Regulation. The exemption applies to long livestock semitrailers defined as those with a maximum length of 14.6 metres and a distance from the front articulation point to the rear not exceeding 13.2 metres, provided they are used for carrying livestock (section 7).
The Notice imposes certain conditions and requirements on the use of these semitrailers. Firstly, the semitrailer can only be used in a combination where a prime mover is towing a single semitrailer (section 11). It must not have more than two decks and must not carry cattle on more than one deck (sections 12 and 13). The lower deck must be fully loaded before the upper deck is used, and the deck length available for the carriage of livestock must not exceed the total length of the semitrailer (sections 14 and 15). Furthermore, the vehicle is limited to transporting cattle, pigs, sheep, or goats, and the driver and operator must comply with all conditions set out in the relevant Schedule when operating in New South Wales or Victoria (sections 16 and 17).
For breaches of the conditions outlined in this Notice, the legislation does not specify particular offences or penalties within the Notice itself. However, violations of the Heavy Vehicle National Law, including non-compliance with the conditions set out in this Notice, could potentially result in penalties as prescribed under the broader legislative framework. These penalties may include fines, suspension of licences, or other enforcement actions as provided under the relevant state or territory laws governing heavy vehicles. It is essential for operators to adhere strictly to the conditions to avoid any potential enforcement actions or legal consequences.
