NATIONAL HEAVY VEHICLE STANDARDS (WARNING SIGNS FOR COMBINATIONS LONGER THAN 22m) EXEMPTION NOTICE 2019 (No.1)
- Purpose
The purpose of this notice is to provide transitional arrangements for operators of certain heavy combinations by way of an exemption from the requirements of Part 3, Section 5 of Schedule 3 of the Heavy Vehicle (Vehicle Standards) National Regulation (the National Regulation).
Note: On 10 December 2019, simplified requirements for warning signs for combinations longer than 22m were introduced into the National Regulation. This notice seeks to establish a ‘status quo’ arrangement for a period of 2 years to enable operators to transition to the new arrangement.
2. Authorising Provision
This Notice is made under section 61 of the Heavy Vehicle National Law (the National Law) as in force in each participating jurisdiction.
3. Title
This Notice may be cited as the National Heavy Vehicle Standards (Warning Signs for Combinations Longer than 22m) Exemption Notice 2019 (No.1).
4. Commencement
This Notice commences on 10 December 2019.
5. Expiry
This Notice expires on 9 December 2021.
6. Definitions
(1) Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the National Law.
(2) In this section:
long vehicle warning sign means a long vehicle warning sign complying with section 6 of Schedule 3 of the Regulation.
road train warning sign means a road train warning sign complying with section 6 of Schedule 3 of the Regulation.
7. Application
(1) This Notice applies in all participating jurisdictions.
(2) This Notice applies to:
(a) A road train combination longer than 22m, but not longer than 30m,
(b) A road train combination that does not include a dog trailer and is longer than 30m, but not longer than 36.5m,
(c) A combination that is not a road train and is longer than 30m, but not longer than 36.5m
8. Exemption from Prescribed Vehicle Standards
A heavy vehicle, to which this notice applies, is exempt from the requirements of Part 3, Section 5 of Schedule 3 of the National Regulation when operating in accordance with this notice.
9. Conditions
(1) A road train combination longer than 22m, but not longer than 30m, must display a Road Train sign at the front and rear.
(2) A combination, other than a road train that includes a dog trailer, longer than 30m, but not longer than 36.5m, must display a long vehicle warning sign at its rear.
(3) The vehicle must comply with all other requirements of Part 3 of Schedule 3 of the National Regulation
(4) The vehicle must continue to comply with any conditions stated in the relevant Access authority.
