Heavy Vehicle National Law
Pursuant to s740A(4) of the Heavy Vehicle National Law, prescribed fees under the Heavy Vehicle (General) National Regulation for the 2020/21 financial year are hereby set out in Schedule 1 of this Notice.
The fees in Schedule 1 take effect on 1 July 2020.

*Indicates an amount where the annual CPI increase for the 2020/21 Financial Year has been waived by the National Heavy Vehicle Regulator under s740(6) of the Heavy Vehicle National Law. The waiver of fees is effective until 11 January 2021 whereby fees will increase as per CPI calculation for the 2020/21 Financial Year.
Overview
The Heavy Vehicle National Law (HVNL) was enacted to establish a nationally consistent framework for the regulation of heavy vehicles in Australia. This law was introduced to address the problem of inconsistent heavy vehicle regulations across different states and territories, aiming to ensure uniform safety and operational standards. The HVNL was enacted by the Parliament of Australia and the policy objective was to enhance road safety and efficiency by streamlining heavy vehicle regulations. Pursuant to section 740A(4) of the HVNL, the National Heavy Vehicle Regulator issued a notice setting out the prescribed fees for the 2020/21 financial year. These fees, effective from 1 July 2020, cover various applications related to maintenance management, mass management, and other accreditations required for heavy vehicle operators and drivers. Notably, certain fees were adjusted to reflect the Consumer Price Index for the financial year, with adjustments taking effect from 12 January 2021.
Scope and Application
The Heavy Vehicle National Law, as evidenced by the Gazetted Schedule for the National Heavy Vehicle Regulator Prescribed Fees for the 2020/21 financial year, applies to various heavy vehicle operators, drivers, and entities involved in heavy vehicle transport across Australia. This Act, which is national in scope, governs fees associated with applications for accreditations and permits, such as maintenance management, mass management, BFM, and AFM accreditations, and applications for written work diaries, mass or dimension exemptions, and class 2 heavy vehicle authorisations. The fees listed in the Schedule 1 of the Notice, effective from 1 July 2020, are prescribed under the Heavy Vehicle (General) National Regulation and pertain to the services provided by the National Heavy Vehicle Regulator. Notably, the fees outlined in the Schedule take into account the current financial year and are subject to adjustments based on the Consumer Price Index, with certain annual CPI increases waived until 11 January 2021. The application of this Act extends through subordinate instruments, which may further define or refine the fees and their application.
Key Provisions
Pursuant to section 740A(4) of the Heavy Vehicle National Law, the legislation establishes the prescribed fees for the 2020/21 financial year, which are outlined in Schedule 1 of this Notice. These fees apply to various applications and accreditations related to heavy vehicle management and operations. For instance, an application for maintenance management accreditation by an operator of a heavy vehicle is subject to a fee of $88 (Fee #1). Similarly, an application for mass management accreditation by an operator of a heavy vehicle also incurs a fee of $88 (Fee #4). Other fees are set for additional services such as adding vehicles to existing accreditations, obtaining a written work diary for fatigue-regulated heavy vehicles, and applying for various permits and exemptions.
Entities governed by this Act, including operators of heavy vehicles and drivers, must adhere to the fees outlined in Schedule 1 when submitting applications for accreditation, permits, or other regulatory requirements. For example, an operator seeking to add vehicles to their maintenance management accreditation must pay a fee of $32 per vehicle (Fee #2). Additionally, a driver of a fatigue-regulated heavy vehicle must pay $25 to apply for a written work diary (Fee #11). These fees are intended to cover the costs associated with processing applications and ensuring compliance with heavy vehicle regulations.
Breach of the requirements outlined in the Heavy Vehicle National Law can result in various penalties and consequences. Although the specific offences and penalties are not detailed within this Notice, it is generally understood that non-compliance with the prescribed fees and application procedures can lead to administrative penalties. These may include fines or other enforcement actions taken by the National Heavy Vehicle Regulator.
