This exemption applies to vehicles that were first registered prior to 1 July 2006 and are currently fitted with such systems, allowing them to exceed the 2.5m width limit. The exemption is geographically applicable to New South Wales, Victoria, and Queensland, with specific conditions for Queensland as outlined in the Notice. Despite the exemption from the width requirement, these vehicles remain subject to all other requirements of the Heavy Vehicle National Law, including mass and other dimension requirements. Key Provisions

The main operative sections of the National Class 3 Mechanical Tarping and Safety Harness Systems Dimension Exemption Notice 2019 (No. 1) (Notice) are sections 8 through 16, which define the scope of the exemption from the width limit specified in section 7(1) of Schedule 6 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (National Regulation). The Notice provides that certain heavy vehicles, specifically those that were first registered before 1 July 2006 and have been fitted with a Mechanical Tarping System or a Safety Harness System, are exempt from the width requirement under certain conditions (sections 8 and 10). The exemption applies in New South Wales, Victoria and Queensland, with specific conditions applying to Queensland (section 9). The relevant heavy vehicles may travel on all areas and routes in the jurisdictions to which the Notice applies, provided they do not exceed certain width limits and the Mechanical Tarping System or Safety Harness System does not protrude more than 50mm on either side of the vehicle (sections 11 to 16). The Act imposes several obligations and requirements on the parties it governs. First, the heavy vehicles must comply with all conditions set out in the Notice, including the width limits, the prohibition on exceeding 2.6m in width including the Mechanical Tarping System or Safety Harness System, and the requirement that any part of the vehicle wider than 2.5m must be more than 2m from the ground (sections 13 to 16). Second, the vehicle must be registered before 1 July 2006 and must have been fitted with a Mechanical Tarping System or a Safety Harness System (section 8). Third, the vehicle must be subject to the exemption from the width limit in section 7(1) of Schedule 6 of the National Regulation (section 10). Fourth, the vehicle must not be wider than 2.6m including the Mechanical Tarping System or Safety Harness System and must not protrude by more than 50mm on either side of the vehicle (sections 14 and 15). Fifth, any part of the vehicle wider than 2.5m must be more than 2m from the ground (section 16). There are no specific offences, penalties or consequences for breach of the Notice. However, any breach of the conditions set out in the Notice may result in the vehicle being deemed to be non-compliant and subject to enforcement action by the relevant authorities. In addition, the exemption from the width limit in section 7(1) of Schedule 6 of the National Regulation does not exempt the vehicle from other requirements of the Heavy Vehicle National Law, including mass and other dimension requirements. Therefore, any breach of these requirements may result in enforcement action, including fines and penalties, as provided for under the Heavy Vehicle National Law and the relevant regulations.
