Exemption

1                      Purpose

The purpose of this Notice is to consolidate in a single dimension exemption Notice a range of schemes under which dimension exemption permits are currently provided to class 1 heavy vehicles in New South Wales, South Australia and Victoria.

Notes—

This Notice exempts certain class 1 heavy vehicles from stated dimension requirements. It does not exempt a class 1 heavy vehicle to which it applies from the mass requirements in the HVNL. Exemption from the HVNL mass requirements may be available through—

• a mass exemption notice issued under the HVNL or corresponding former legislation; or
• a mass exemption permit issued under the HVNL.

Nothing in this Notice exempts the driver or operator of the vehicle from complying with legislation regulating the use of heavy vehicles, including but not limited to—

• official traffic signs, including those indicating mass limits or dimension limits;
• vehicle standards in the HVNL; and
• directions of authorised officers.

A load carrying vehicle that does not comply with the mass requirements of the HVNL may be subject to additional conditions of operation including route and time of travel restrictions.

2                       Authorising provision

This Notice is made under section 117 of the Heavy Vehicle National Law as applied in each participating jurisdiction.

3                      Application

This Notice applies —

(a)          in New South Wales, South Australia and Victoria;

(b)          to a heavy vehicle that exceeds a dimension limit in the Heavy Vehicle National Law and—

(i)           is a carrying, or designed for the purpose of carrying, a large indivisible item, including, for example, a combination including a low loader; but

(ii)         is not a road train or B-double, or carrying a freight container designed for multi-modal transport.

4                      Commencement

(1)         This Notice, except for Schedule 2, commences on 11 July 2016.

(2)         Schedule 2 commences on 15 July 2016.

5                      Expiry

 This Notice expires on 10 July 2021.

6                       Definitions

(1)          A reference in this Notice to a heavy vehicle includes a reference to its load except where otherwise stated in this Notice.

(2)          In this Notice—

eligible vehicle means a load carrying vehicle that —

(a)   does not comply with a prescribed dimension requirement applying to it; and

(b)   is carrying one or more indivisible items; and

(c)    is designated in a Schedule of this Notice as an eligible vehicle.

HVNL means the Heavy Vehicle National Law.

MDL National Regulation means the Heavy Vehicle (Mass, Dimension and Loading) National Regulation.

7                       Exemption from prescribed dimension requirements

 This Notice exempts an eligible vehicle to which it applies from the following dimension requirements in Schedule 6 of the MDL National Regulation to the extent provided in this Notice, including its Schedules—

(a)   section 3(1)(a) – Length—general; and

(b)   section 4(2) – Length—trailers; and

(c)    section 5(1)(a) and (b) - Length—rear overhang; and

(d)   section 7(1)—Width; and

(e)   section 8(d)—Height; and

(f)     sections 13(a)(ii) and 13(b)(ii)—Front and side projection of load.

Note—

Sections 13(a)(ii) and 13(b)(ii) only refer to the side projection of a load (for a truck, and a combination, respectively).

8                       General operating conditions – section 119 HVNL

If a load on an eligible vehicle can be safely loaded in more than one way, it must be loaded in a way that minimises the dimensions, prioritising minimum width, of the vehicle and its load to the greatest extent practicable.

9                      Additional route assessment conditions

(1)         For the purposes of section 11 of Schedule 8 of the MDL National Regulation—

(a)          the driver or operator of an eligible vehicle must undertake a route survey before travel to ensure that the vehicle can do so safely and without—

(i)           damaging road, structure (including a bridge), rail crossing, tree, road infrastructure, or roadside furniture; or

(ii)         disrupting essential services, including telecommunication, electricity, rail, gas, water or sewage services.

(b)          prior to commencing a journey a driver or operator of an eligible vehicle must check a route network map mentioned in the relevant Schedule of the Notice for updates and any restrictions or limitation applying to the proposed route.

(2)         For the purposes of section 11(1) of Schedule 8, the driver or operator must, before commencing the relevant journey, identify any relevant road closures and road conditions or restrictions that may inhibit the movement of the eligible vehicle.

10                  Operation of Schedules

A vehicle operating under this Notice must comply with the conditions set out in the Schedule for a participating jurisdiction where the vehicle is being used.

Schedule 1 New South Wales

Part 1 Application in this jurisdiction

1                      Definitions for this Schedule

In this Schedule—

2014 LCV Notice means the Class 1 Load Carrying Vehicles Notice 2014 made under the Road Transport (Mass, Loading and Access) Regulation 2005 (NSW) as amended.

Christmas school holidays means the holidays of that name set by the NSW Department of Education and Communities.

public holiday means a public holiday made under the Public Holidays Act for the whole State.

public holiday period means-

(a)          a period of three or more consecutive days covering a declared NSW Statewide public holiday and adjacent weekend days (for example Easter and every long weekend); and

(b)          the period between 23 December and 3 January (inclusive).

2                      Vehicles and vehicle categories

(1)          This Schedule applies to a load carrying vehicle that is comprised of—

(a)          a truck; or

(b)          a truck and heavy trailer combination; or

(c)          a prime mover towing—

(i)           a low loader; or

(ii)         a low loader dolly and a low loader; or

(iii)        a semitrailer; or

(iv)        a jinker trailer.

(2)          A vehicle mentioned in subsection (1) is an eligible vehicle in this Schedule.

3                      Maximum permissible dimensions condition

(1)         An eligible vehicle must not exceed—

(a)          a dimension limit mentioned in Table 1; or

(b)          for a combination described in section 2(1)(c) of this Schedule, a rear overhang limit mentioned in Table 2 or 25% of the length of the heavy vehicle, whichever is the lesser.

(2)          A loaded vehicle higher than 4.6m must carry its load on a vehicle or trailer with a deck height no more than 1.0m above the ground.

4                      Areas or routes to which this Schedule applies

An eligible vehicle—

(a)          may operate on a route specified on the map titled ‘NSW Oversize Overmass Load Carrying Vehicles Network’ set out at www.rms.nsw.gov.au/hv-maps;  and

(b)          that is higher than 4.3m may only operate on a route that is also approved for 4.6m high vehicles as displayed on the map titled NSW Oversize Overmass Load Carrying Vehicles Network’ set out at www.rms.nsw.gov.au/hv-maps.

Additional travel conditions and restrictions that are not displayed on the map are contained in the NSW Schedule of this Notice.

Part 2 Operating conditions

Division 1 General operating conditions

5                      General conditions

(1)        Without limiting the routes and areas set out in section 4 of this Schedule, an eligible vehicle must also comply with the requirements set out in Appendix 2 of the 2014 LCV Notice, unless otherwise stated in this Notice.

(2)        Travel is permitted at daytime, and at night in accordance with the night travel requirements set out in Appendix 2 of the 2014 LCV Notice.

Note—

Section 7 (Travel restrictions at night) of Schedule 8 of the MDL National Regulation is disapplied to allow night travel.

(3)         An eligible vehicle that is authorised to use a route specified in section 4 of this Schedule must do so in accordance with any condition, including any restriction on the hours or days of operation, specified for that route.

(4)         Where an eligible vehicle is higher than 4.3m but does not exceed another prescribed dimension requirement applying to the vehicle, travel is not subject to public holiday and public holiday period travel restrictions in Appendix 2 of the 2014 LCV Notice.

(5)         The operator of an eligible vehicle equal to or wider than 4.3m must contact the motorway operator at least 5 working days before travelling on the M5 West Motorway or M7 Motorway.

(6)         The operator of an eligible vehicle that is wider than 3.5m must contact the motorway operator or project control room at least 5 working days before travelling on—

(a)          the M2 Motorway between Abbott Road at Seven Hills and Epping Road at North Ryde; or

(b)          Pennant Hills Road between the M2 Motorway interchange at West Pennant Hills and the M1 Pacific Motorway interchange at Normanhurst.

(7)         The operator of an eligible vehicle that is wider than 3.5m or longer than 25.0m must contact the RMS Pacific Highway Coordinator at least 48 hours prior to travel on the Pacific Highway.

Division 2 Pilot and escort vehicle requirements

6                       Conditions - Pilot and escort vehicles

(1)          The driver and operator of an eligible vehicle and the driver of a pilot vehicle must comply with the pilot vehicle requirements listed in Appendix 2 of the 2014 LCV Notice.

(2)         An eligible vehicle operating in the daytime that is wider than 3.5m or longer than 26.0m requires one pilot vehicle.

(3)         An eligible vehicle operating at night that is—

(a)          wider than 2.5m or longer than 22.0m requires one pilot vehicle; and

(b)          wider than 3.5m or longer than 26.0m requires 2 pilot vehicles.

(4)         When travelling on the Pacific Highway the pilot vehicle requirements in Table 3 apply.

(5)         When travelling on the Great Western Highway at night between midnight and sunrise the pilot vehicle requirements in Table 4 apply.

(6)         Where a condition in this Schedule requires contact with the NSW Police for additional pilot or escort vehicle requirements, the written advice received from the NSW Police must be carried in the vehicle and produced when requested by an Authorised Officer.

Division 3 Additional restrictions

7                      Additional restrictions

Notwithstanding anything else in this Schedule or Appendix 2 of the 2014 LCV Notice, an eligible vehicle is subject to the following restrictions and any condition applicable to the restriction—

(a)          during weekdays other than public holidays, the restrictions in Table 5; and

(b)          during weekends and statewide public holidays, the restrictions in Table 6; and

(c)          during the Christmas school holidays, the restrictions in Table 7.

Schedule 2 South Australia

Part 1 Application in this jurisdiction

Division 1 Preliminary

1                      Definitions for this Schedule

In this Schedule—

Adelaide Hills Area means the area described in the map of that name published at—

Adelaide Metropolitan Area means the area described in the map of that name published at—

www.sa.gov.au/topics/transport-travel-and-motoring/heavy-vehicles/operating-a-heavy-vehicle/approved-areas-and-routes-maps

DPTI means the South Australian Department of Planning, Transport and Infrastructure

South Australian Country Area means an area in South Australia other than the Adelaide Metropolitan Area or the Adelaide Hills Area.

Division 2 Vehicle characteristics

2                      Vehicles and vehicle categories

(1)          This Schedule applies to a heavy vehicle that is comprised of a prime mover with a single steer axle and a dual-drive tandem axle group, towing —

(a)          a low loader; or

(b)          a low loader dolly and a low loader.

(2)         A vehicle mentioned in subsection (1) is an eligible vehicle in this Schedule.

3                       Maximum permissible dimensions condition

An eligible vehicle must not exceed a dimension limit mentioned in Table 1.

4                      Rear overhang

The maximum rear overhang of an eligible vehicle must be no more than 5.5m, or 25% of the length of the heavy vehicle, whichever is the lesser.

Division 3 Areas or routes to which this Schedule applies

An eligible vehicle that is-

(a)          not wider than 4.0m may operate on a route specified on the map titled  ‘4.0m Wide up to 93.5t Low Loader’; or

(b)          wider than 4.0m but not wider than 4.5m may operate on a route specified on the map titled ‘4.5m Wide up to 93.5t Low Loader’.

Part 2 Operating conditions

Division 1 General operating conditions

6                       General conditions

(1)         an eligible vehicle must comply with a condition applying to the route or area specified on a RAVnet map in section 5 of this Schedule.

(2)         Travel is only permitted in the daytime.

(3)         Travel is not permitted in the Adelaide Metropolitan Area between the hours of 7:00am to 9:00am, and 4.00pm to 6.00pm, Monday to Friday inclusive.

(4)         No part of any cross member used to support the load carried on an eligible vehicle shall protrude laterally more than 50mm from the point of support of the load.

(5)         A low loader combination must not be assembled or disassembled on any approved route unless—

(a)          the vehicle is broken down; or

(b)          under the direction of an Authorised Officer or a Police Officer.

(6)         Designated truck parking areas must only be used for rest purposes or vehicle checks and not for assembly or disassembly purposes.

(7)         All entry into and out of premises must be in a forward direction only, unless safe and appropriate traffic control mechanisms are in place.

(8)          If an eligible vehicle is higher than 4.3m, the operator must, before starting a  journey—

(a)     consult SAPN regarding height clearances under power lines along the route.

(b)     consult TELSTRA regarding height clearances under telecommunication lines along the route.

(c)      consult OPTUS (when travelling within the OPTUS Clearance Area) regarding height clearance under telecommunication lines along the route

(9)         An operator or driver of an eligible vehicle that is wider than 4.0m must have SA Police in attendance to preserve safety and direct traffic whilst travelling over the following structures—

(a)          Port Augusta Bridge - Port Augusta Police;    

(b)          Swanport Bridge - Murray Bridge Police;  

(c)          Blanchetown Bridge -  Blanchetown Police;

(d)          Kingston Bridge - Barmera Police

(10)     The driver or operator of an eligible vehicle must contact the Port Augusta- Tarcoola train control before entering, and immediately after clearing, the rail level crossing on Yorkey’s Crossing.

(11)      The driver or operator of an eligible vehicle must contact the Port Augusta- Tarcoola train control 24 hours prior to traversing the level crossing on Footner Rd, Port Augusta.

Division 2 Pilot vehicle requirements

7                       Pilot vehicle requirements – Adelaide Metropolitan Area

(1)          An eligible vehicle operating in the Adelaide Metropolitan Area must be accompanied by pilot vehicles in accordance with the chart in Figure 1.

(2)         The pilot vehicle requirements in subsection (1) do not apply—

(a)          from clear of the intersection of Portrush, Cross Road and South Eastern Freeway (EAST BOUND) on the South Eastern Freeway; and

(b)          from the Salisbury Highway Overpass junction with Port Wakefield Road, Port Wakefield Road only to the boundary of the Adelaide Metropolitan Area at the Gawler River travelling in either direction (NORTH and SOUTH BOUND), only if no pilot vehicles are required in the country area (north of the Gawler River) according to the chart in Figure 2.

Note –

The number of pilot vehicles is determined by the point at which the overall width and overall length of the vehicle and load intersect on the chart, and where it exceeds the drawn lines, either in the 1 pilot or the 2 pilot vehicle areas on the chart.

For example, if the vehicle is 28.0m long and 4.0m wide, it requires 2 pilot vehicles.  If the vehicle is 22.0m long and 4.0m wide, it only requires 1 pilot vehicle as the intersection point is on the line.

8                      Extended operation of pilot vehicle requirements when travelling into and out of the Adelaide Metropolitan Area

The pilot vehicle requirements in section 7 also apply—

(a)          from the parking bay 16.0km west of the Callington Interchange on the South Eastern Freeway to the Adelaide Metropolitan Area (WEST BOUND); and

(b)          from Lower Light on the Port Wakefield Highway to the Adelaide Metropolitan Area (SOUTH BOUND); and

(c)          from the Adelaide Metropolitan Area on the Sturt Highway to the just east of Accommodation Hill travelling in both directions (east and west); and

(d)          from the Adelaide Metropolitan Area on the Sturt Highway (EAST BOUND), then via Halfway House Road, Sedan, Ridley Road, Cambrai, Mannum Road, Murray Bridge via route OD4 as signposted, Swanport Bridge, Princes Highway to the parking bay at the Monteith intersection (approximately 3km east of Swanport Bridge); and

(e)          from Tailem Bend, on the Princes Highway (WEST BOUND), Swanport Bridge, via OD4 Murray Bridge, Mannum Road, Cambrai, Ridley Road, Sedan, Halfway House Road, Sturt Highway (WEST BOUND) to the Adelaide Metropolitan Area.

9                      Pilot vehicle requirements – South Australian Country Area

Subject to the pilot requirement extensions in section 8 of this Schedule, an eligible vehicle operating in the South Australian Country Area must be accompanied by one or two pilot vehicles in accordance with the chart in Figure 2.

10                  Pilot vehicle requirements - general

(1)         A pilot vehicle driver must operate in accordance with, and carry a copy of, the booklet titled `Escorting Guidelines for Oversize and Overmass Vehicles and Loads’, published by DPTI.

(2)          Where the driver  of an eligible vehicle that is wider than 3.5m cannot, by means of rear vision mirrors, obtain a clear reflected view of traffic to the sides and rear of the vehicle—

(a)          a rear pilot vehicle must be used to provide the driver of the oversize vehicle with information regarding vehicles approaching from the rear; and

(b)          if a rear pilot vehicle is required in accordance with the Pilot Requirements in section 7 to 9, and paragraph (a), the one pilot vehicle can be used for both purposes.

This Notice does not relieve the driver or any other person of the obligation to comply with the requirements of the Road Traffic Act 1961 (SA), or regulations and rules under that Act, or any other statutory provisions, other than the dimension limits from which the vehicle is exempted by this Notice.

A person operating under this Notice is advised that some parts of the road system bridges, signs, roadside furniture and vegetation may not provide sufficient clearance for the passage of a vehicle and load at the dimensions permitted by this Notice.

Section 107 of the Road Traffic Act 1961 (SA)(Damage to Road Infrastructure) requires an operator to notify the South Australia Police, DPTI or the relevant Council, if damage is caused to roads, bridges and culverts, or if an operator interferes with roadside furniture without reasonable excuse.

Schedule 3 - Victoria

Part 1 Application in this jurisdiction

Division 1 Preliminary

1                      Definitions for this Schedule

 In this Schedule—

certified pilot vehicle means a pilot vehicle driven by a driver who has—

(a)          a minimum of twelve months comprehensive experience in piloting oversize loads; and

(b)          successfully completed a training program detailed on VicRoads website through a Registered Training Organisation.

DEDJTR means the Department of Economic Development, Jobs, Transport and Resources.

freeway has the meaning provided in the Road Rules.

holiday period means a period of three or more consecutive days consisting of any of the following—

(a)          a State-wide school holiday;

(b)          a public holiday; or

(c)          a Saturday; or

(d)          a Sunday.

major road means a highway declared under regulation 6(e) of the Road Safety (Vehicles) Regulations 2009 (Vic) or the MDL National Regulation as a major road.

public holiday means New Year's Day, Australia Day, Christmas Day, Boxing Day, Labour Day, Good Friday, Easter Monday, Anzac Day, and Queen's Birthday.

rural area means an area of operation in Victoria other than the following—

• Colac Surf Coast Area;

• Gippsland Ranges Area;

• Melbourne and Geelong Urban Area;

• Mountainous Area; and

• Otway Area.

as specified in the Oversize & Overmass (OSOM) map in section 4 of this Schedule.

Road Rules has the same meaning as it has in section 5 of the HVNL.

s-dimension means the distance between the kingpin on the trailer and the rear overhang line.

urban area means an area declared to be an urban area under the Road Safety (Vehicles) Regulations 2009 (Vic) or the MDL National Regulation.

Division 2 Vehicle characteristics

2                      Vehicles and vehicle categories

(1)          This Schedule applies to a heavy vehicle that is comprised of— 

(a)          a truck; or

(b)          a truck and heavy trailer combination; or

(c)          a prime mover towing—

(i)           a low loader; or

(ii)         a low loader dolly and a low loader; or

(iii)        a semitrailer; or

(iv)        a jinker trailer.

(2)          A vehicle mentioned in subsection (1) is an eligible vehicle in this Schedule.

3                      Maximum permissible dimensions condition

 An eligible vehicle must not exceed a dimension limit applying to the vehicle that is mentioned—

(a)          in Table 1; or

(b)          in Table 2, or 25% of the length of the heavy vehicle, whichever is the lesser.

 An eligible vehicle may only operate on the routes specified in the Oversize & Overmass (OSOM) map set out at VicRoads website.

Part 2 Operating conditions

Division 1 General operating conditions

5                      Times when a heavy vehicle may be used on a road under this Schedule

(1)          An eligible vehicle that is authorised to use a route specified in section 4 of this Schedule must do so in accordance with any condition, including any restriction on the hours and days of operation, specified for that route.

(2)         Travel is permitted at daytime and at night in accordance with the requirements of this Schedule.

(3)         Subject to subsections (4) to (8), an eligible vehicle described in Table 3 may only be operated on a route or in an area in Table 3 on a day mentioned in column A during a time mentioned in column B to D for that route or area.

 Note—

A reference in Table 3 to ‘Monday – Friday’ means a day other than a public holiday.

(4)          An eligible vehicle may operate on Coode Road, Appleton Dock Road, MacKenzie Road or Anderson Road in West Melbourne at any time.

(5)         An eligible vehicle that is more than 4.6m high must not be operated after sunset outside the Melbourne and Geelong urban areas.

(6)          An eligible vehicle must not travel from 23 December to 3 January inclusive on—

(a)          a major road; or

(b)          the Calder Highway; or

(c)          the Hume Highway; or 

(d)          the Northern Highway; or

(e)          a freeway outside the Melbourne & Geelong urban areas.

(7)          An eligible vehicle must not travel on the Melba Highway or Warburton Highway on—

(a)          a weekend or public holiday; or

(b)          the day before the start of a holiday period; or

(c)          the last day of a holiday period.

(8)          An eligible vehicle must comply with night travel lighting conditions when travelling—

(a)          on the Princes Freeway between Laverton and Geelong between 1.00am and 5.00am; or

(b)          in the Melbourne or Geelong urban area during the hours of darkness.

In this sub section-

night travel lighting conditions means the conditions set out in section 5 (Side and rear markers and warning lights for oversize vehicles used at night) of Schedule 8 of the MDL National Regulation.

6                       Skid Rails

 Non-conductive skid rails must be attached to the top of the load on an eligible vehicle if the vehicle is higher than 4.8m and the vehicle travels under tram wires. 

7                      Convoys

An eligible vehicle must not travel in a convoy.

8                       Carriage of documents

 The driver of an eligible vehicle must carry the VicRoads information bulletin, Height under Structures for Permit Vehicles – June 2007 and Height Clearance on Roads (when in excess of 4.3m) and produce it to an authorised officer on request.

9                       Communication with other entities

 Before the commencement of any journey, the operator of an eligible vehicle must contact an entity mentioned in column 1 of Table 4 where the eligible vehicle will or may reasonably be expected to meet any of the conditions set out in column 3.

Division 2 Pilot vehicle requirements

10                   Melbourne and Geelong Urban Area

 An eligible vehicle operating in the Melbourne and Geelong Urban Area that is mentioned in column 1 of Table 5 or Table 6 must be accompanied by a pilot vehicle —

(a)          mentioned in column 2; and

(b)          positioned in accordance with column 3

11                  Rural areas

 An eligible vehicle operating in a rural area with or without a dolly must be accompanied by—

(a)          a certified pilot vehicle positioned at the rear of an eligible vehicle when the rear overhang of the vehicle exceeds 6.0m; or

(b)          a pilot vehicle or a certified pilot vehicle in the circumstances specified in Figure 1.
