1                      Authorising provision

This Notice is made under section 175 of the Heavy Vehicle National Law and section 19 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation, as they apply in New South Wales.

2                      Operation

In order to prevent or minimise serious harm to public safety or significant damage to road infrastructure the Regulator immediately suspends insofar as they apply to the suspended routes set out in section 7:

(a)           each authority issued under section 117 or section 138 of the Heavy Vehicle National Law; and

(b)          each declaration issued under section 12 of the Heavy Vehicle (Mass Dimension and Loading) National Regulation.

3                      Commencement Date

This Notice commences immediately upon publication in the Commonwealth Gazette.

4                      Expiry

This Notice expires on the earliest of the following—

(a)           The Regulator publishes a notice amending or cancelling an authority as it relates to  a route mentioned in section 7; or

(b)          The Regulator publishes a notice cancelling this suspension; or

(c)           The end of 56 days after the day this Notice is published.

5                      Title

This Notice may be cited as the Immediate Suspension Notice (Newell Highway) Notice 2016 (No.1).

6                      Definitions

(1)         Unless otherwise stated, words and expressions used in this Notice have the same meanings as those defined in the HVNL.

(2)         In this notice:

Authority means a mass or dimension authority or exemption, or Higher Mass Limits declaration, issued as a Gazette Notice under the HVNL or its Regulations.

7                      Application

This Notice applies to an authority or declaration specified in section 2 insofar as it applies to the following sections of the Newell Highway in New South Wales:
