HVNL Interim Guidelines for Industry Codes of Practice (July 2014) Amendment Notice 2016 (No. 3)

1                      Authorising provision

This Notice is made under sections 705 and 706 of the Heavy Vehicle National Law as applied in each participating jurisdiction.

2                      Purpose

The purpose of this Notice is: 

(1)          to amend the HVNL Interim Guidelines for Industry Codes of Practice (July 2014) (the Interim Guidelines); and

(2)         to state the status of industry codes of practice currently registered under the Interim Guidelines.

3                      Commencement

This Notice commences on the date of its publication in the Commonwealth Gazette.

4                      Title

This Notice may be cited as the HVNL Interim Guidelines for Industry Codes of Practice (July 2014) Amendment Notice 2016 (No.3).

5                      Amendment of the Interim Guidelines

6                      Continuation of registration of certain codes

(1)         The following industry codes of practice, registered on 21 August 2014 under the Interim Guidelines, continue to be registered, pursuant to 706 of the Heavy Vehicle National Law until twelve months has elapsed after the expiry of the Interim Guidelines.

National Logistics Safety Code (Vic)

Retail Logistics Supply Chain Code of Practice (Vic)

Refrigerated Warehouse & Transport Association of Australia Chain of Responsibility – Code of Practice (Vic)

Trucksafe Operator Business Rules and Code of Conduct (Vic)

Australian Steel Industry Logistics Safety Code (Vic)

Heavy Vehicle Transport Off-Farm Grain Carriers’ Code of Practice (SA)

 

(2)         In each case, the continuing registration of a code of practice is subject to the same conditions as those imposed when a code of practice was first registered.

Overview

The Heavy Vehicle National LawHVNL Interim Guidelines for Industry Codes of Practice (July 2014) Amendment Notice 2016 (No. 3) was enacted to amend the interim guidelines for the registration of industry codes of practice under the Heavy Vehicle National Law (HVNL) as applied in each participating jurisdiction. This amendment notice was made under sections 705 and 706 of the HVNL and aims to modify the HVNL Interim Guidelines for Industry Codes of Practice and to specify the status of industry codes of practice registered under the interim guidelines. The notice came into effect on the date of its publication in the Commonwealth Gazette. The policy objective, as stated, is to ensure the continued registration of certain industry codes of practice until twelve months after the expiry of the interim guidelines, subject to the same conditions as initially imposed. This legislative action was taken by the National Heavy Vehicle Regulator under the authority granted by the HVNL to address the need for an updated framework for the registration of industry codes of practice in the heavy vehicle industry.

Scope and Application

The HVNL Interim Guidelines for Industry Codes of Practice (July 2014) Amendment Notice 2016 (No. 3) applies to industry codes of practice in the heavy vehicle sector that were registered under the Interim Guidelines, specifically those registered on 21 August 2014. The Notice is made under sections 705 and 706 of the Heavy Vehicle National Law as applied in each participating jurisdiction, and it operates on a national level across all jurisdictions that have adopted the Heavy Vehicle National Law. This Notice amends the original Interim Guidelines by extending the registration period of certain codes of practice until twelve months after the expiry of the Interim Guidelines, subject to the same conditions initially imposed. The Notice also clarifies the status of these registered codes of practice post the Interim Guidelines' expiry. The amendment is designed to ensure that the industry codes of practice continue to be recognised and enforced without interruption, providing stability and continuity in the regulation of heavy vehicle logistics and safety across the participating jurisdictions.

Key Provisions

The HVNL Interim Guidelines for Industry Codes of Practice (July 2014) Amendment Notice 2016 (No. 3) primarily serves to modify the existing Interim Guidelines, as well as to clarify the registration status of certain industry codes of practice (section 2). Section 5 of the Amendment Notice modifies the expiry date of the Interim Guidelines, replacing the previous date of 30 November 2016 with a new date specified by the National Heavy Vehicle Regulator when they publish the Guidelines for the Registration of Industry Codes of Practice (section 5). Additionally, it ensures the continued registration of certain codes of practice registered on 21 August 2014 under the Interim Guidelines until twelve months after the Interim Guidelines expire (section 6). These codes of practice include the National Logistics Safety Code (Vic), Retail Logistics Supply Chain Code of Practice (Vic), Refrigerated Warehouse & Transport Association of Australia Chain of Responsibility – Code of Practice (Vic), Trucksafe Operator Business Rules and Code of Conduct (Vic), Australian Steel Industry Logistics Safety Code (Vic), and Heavy Vehicle Transport Off-Farm Grain Carriers’ Code of Practice (SA) (section 6(1)). The continued registration of these codes is subject to the same conditions as those initially imposed (section 6(2)). Under the Heavy Vehicle National Law, the National Heavy Vehicle Regulator is tasked with ensuring compliance with the requirements of the Act and the Interim Guidelines. The Regulator must monitor the industry codes of practice, verify their compliance with the Interim Guidelines, and maintain the registration of those that meet the standards. The Regulator must also publish the Guidelines for the Registration of Industry Codes of Practice, which will detail the requirements for any new codes of practice and the process for their registration. The Regulator has the authority to review and amend the registration of any codes of practice if they find non-compliance or if circumstances change, thereby ensuring that the industry codes of practice continue to meet the safety and operational standards required by the Act. Failure to comply with the provisions of the Heavy Vehicle National Law and the Interim Guidelines may result in various consequences, both civil and criminal, depending on the nature and severity of the breach. For instance, operators who do not adhere to the registered codes of practice may face penalties under the law, which can include fines and other sanctions. In cases where the non-compliance leads to accidents or harm, the consequences could be more severe, potentially involving criminal charges and imprisonment for those found guilty of gross negligence or willful misconduct. The maximum penalties for breaches of the Heavy Vehicle National Law can vary widely, from fines of thousands of dollars for minor infractions to much higher penalties for serious offences that result in significant harm or loss of life. It is essential for industry participants to understand and comply with the requirements of the Act and the Interim Guidelines to avoid these potential consequences.
