B Double Commodity

District Council of Mount Remarkable

Add the following road conditions for council roads on the B Double Commodity network:

  • Maximum permitted speed of 60km/hr on all unsealed roads.
  • Maximum permitted speed of 25km/hr if the unsealed road is signposted for floodways or narrowing.
  • On unsealed roads, travel is suspended during periods of prolonged rain and up to 1 day for every 5mm of rain within the 24 hours period after the rainfall event. Access maybe further restricted or deferred in the event of a significant rainfall event. Contact must be made with the relevant traffic management information sources on such an occasion.

Assessment of these roads supports speed conditions being imposed, as well as suspension of travel after a prolonged rain event, for public safety and to reduce damage to road infrastructure.

Overview

The Heavy Vehicle National Law, enacted in 2020, was introduced to address the need for a cohesive and streamlined regulatory framework governing heavy vehicles across participating jurisdictions in Australia. This legislation, enacted by the Parliament, aimed to harmonise heavy vehicle regulations to enhance safety, efficiency, and consistency in interstate freight transport. The Heavy Vehicle Stated Maps – Amendment Notice 2020 (No.1) Statutory Instrument, issued under Section 174 of the Heavy Vehicle National Law, further refines the legislative framework by amending stated maps for heavy vehicles at the request of road managers. This amendment seeks to address specific road safety and infrastructure concerns by imposing speed limits and travel suspensions on certain roads within the B Double Commodity network in South Australia, reflecting the policy objective of ensuring public safety and minimising damage to road infrastructure.

Scope and Application

The Heavy Vehicle Stated Maps – Amendment Notice 2020 (No.1) applies to all participating jurisdictions under the Heavy Vehicle National Law, as referenced in the authorising provision of Section 174. This Notice amends stated maps for vehicles at the request of road managers to address specific road conditions and safety measures. The amendments are made to specified networks in Column 2 of Schedule 1, with details of the changes and reasons provided in Columns 4 and 5. These amendments aim to impose speed limits and suspend travel during adverse weather conditions on unsealed roads within the B Double Commodity network in South Australia, as directed by the District Council of Mount Remarkable. The Notice does not specify exclusions or exemptions but provides detailed amendments for the mentioned localities and networks, reflecting the intent to enhance road safety and infrastructure protection through these modifications. The Notice is effective 28 days after its publication, as stipulated, and extends its reach across all participating jurisdictions, thereby ensuring a coordinated approach to managing heavy vehicle routes and conditions.

Key Provisions

The Heavy Vehicle Stated Maps – Amendment Notice 2020 (No.1) primarily serves to modify stated maps for heavy vehicles, as per Section 174 of the Heavy Vehicle National Law as applied in participating jurisdictions (s.1). This Notice is aimed at updating the maps based on requests from road managers (s.2). The amendments outlined in this Notice come into effect 28 days after its publication (s.3). This Notice applies uniformly across all participating jurisdictions (s.5), and the specific changes are detailed in Schedule 1, which outlines the altered routes, localities, and the reasons for these changes (s.6). The obligations imposed by this Notice on the parties it governs primarily include ensuring compliance with the newly specified road conditions for heavy vehicles. For example, within the South Australia locality, on the B Double Commodity network, heavy vehicles must adhere to a maximum speed of 60km/hr on all unsealed roads, and a further reduced speed of 25km/hr if the road is signposted as a floodway or for narrowing (Schedule 1, Column 4). Additionally, during periods of prolonged rain, particularly if there is more than 5mm of rainfall in a 24-hour period, travel on these roads may be suspended, and access may be further restricted or deferred if there is a significant rainfall event (Schedule 1, Column 4). Road managers have assessed these conditions to be necessary for public safety and to mitigate damage to road infrastructure (Schedule 1, Column 5). Failure to comply with the amended conditions specified in this Notice could result in various civil or criminal consequences. While the specific penalties for breaches are not detailed in the Notice itself, under the Heavy Vehicle National Law, penalties for non-compliance can include fines, demerit points, and potentially more severe sanctions depending on the severity and frequency of the breaches. The Notice, however, does not specify the maximum penalties for these breaches, and such details would need to be referred to in the primary legislation or associated regulations.
