Overview

The Heavy Vehicle National Law Guideline for Excess Dimension Agricultural Vehicles and Agricultural Combinations, Form 14 Amendment Notice 2019 (No. 1), was enacted to address the need for a unified approach to the regulation of heavy vehicles across Australia. The Notice aims to extend the operation of a previous Queensland guideline, ensuring consistency and continuity in the management of excess dimension agricultural vehicles and combinations. This legislative measure was introduced by the National Heavy Vehicle Regulator under Section 23 of Schedule 1 of the Heavy Vehicle National Law to provide a smooth transition from state-specific regulations to a national framework. The primary policy objective is to facilitate the safe and efficient movement of agricultural vehicles while maintaining high standards of road safety and operational efficiency across Australia.

Scope and Application

This Amendment Notice 2019 (No. 1) pertains to the extension of the operation of a previous Notice issued under a former corresponding law for the Heavy Vehicle National Law. The primary focus of this Notice is to continue the application of the original Queensland Form 14 until it is fully replaced by a national notice under the Heavy Vehicle National Law. The Notice extends the operational period of the Guideline for excess dimension agricultural vehicles and agricultural combinations, Form 14, Version 4, which was originally published by the Queensland Department of Transport and Main Roads in October 2013. This Amendment Notice applies to the entities and persons involved in the operation of excess dimension agricultural vehicles and agricultural combinations, effectively maintaining the regulatory framework until a new national guideline is established. The jurisdictional reach of this Notice is across the Commonwealth, aligning with the broader objectives of the Heavy Vehicle National Law. The Notice was made under Section 23 of Schedule 1 of the Heavy Vehicle National Law, and it commences on the date of publication in the Commonwealth Gazette. Clause 2.0 of the original Form 14 is specifically amended to include an extension of its operational period until 31 December 2019. This extension ensures that the regulatory standards for heavy vehicles continue to be upheld nationally until the new national notice is issued, thereby maintaining consistency and compliance across jurisdictions.

Key Provisions

The main operative sections of this Notice (C2019G00055) extend the operational period of the Guideline for excess dimension agricultural vehicles and agricultural combinations, Form 14, Version 4, which was originally published by the Queensland Department of Transport and Main Roads in October 2013. Specifically, Section 2.2 of the amended Notice extends the operational period of the original Form 14 until 31 December 2019. This means that the guidelines and regulations contained within the Form 14 will continue to apply to heavy vehicles until a new national notice under the Heavy Vehicle National Law is issued and replaces it. This extension is critical for ensuring that agricultural vehicles and combinations can continue to operate under the same guidelines until a new national standard is established. The obligations and requirements imposed by this Act primarily involve the continuation of the existing guidelines set out in Form 14. Operators of heavy agricultural vehicles and combinations must adhere to these guidelines to ensure compliance with the Heavy Vehicle National Law. This includes maintaining vehicles and combinations within the specified dimensions and conditions outlined in the Form 14. Authorities responsible for enforcing the law must also continue to apply the existing guidelines when inspecting and regulating heavy vehicles until the new national notice is published. This ensures a smooth transition and minimal disruption for operators and regulators alike. In terms of potential offences, penalties, or consequences for breach, the Notice itself does not detail specific penalties. However, any breaches of the Heavy Vehicle National Law, including failure to comply with the extended guidelines of Form 14, could result in enforcement actions under the law. Such actions may include fines, vehicle impoundment, or other penalties as determined by the relevant authorities. The exact penalties would be dictated by the provisions of the Heavy Vehicle National Law, which can include substantial financial penalties and other legal consequences for non-compliance. It is essential for operators to ensure strict adherence to the guidelines to avoid any potential enforcement actions.
