EXPLANATORY STATEMENT

Issued by the Authority of the Minister for Health and Ageing

Health Insurance Act 1973

Health Insurance (Permitted benefits – pathology services) Amendment Determination 2008

This Determination is made under section 23DZZIG of the Health Insurance Act 1973 (the Act).

Part IIBA of the Act contains provisions that are directed at preventing requesters of pathology services and diagnostic imaging services from (either directly or indirectly) asking for or accepting, or being offered or provided, any benefits (other than permitted benefits) in order to induce the requesters to request the services from providers of those services.  It also contains provisions protecting requesters of pathology services and diagnostic imaging services from (either directly or indirectly) being threatened in order to induce the requesters to request the services from providers of those services.

Part IIBA of the Act regulates behaviour whereby providers (or persons connected to them) offer or provide benefits to requesters (or persons connected to them).  It also regulates behaviour whereby requesters (or persons connected to them) seek or accept benefits from providers (or persons connected to them).  Such behaviour may be prohibited by the Act unless the benefit in question is a “permitted benefit”.  The Act prescribes a number of benefits which are permitted, and these generally relate to transactions that are of an arms-length bone-fide commercial nature.

Section 23DZZIG of the Act allows the Minister to determine, by legislative instrument, that a specified class of benefits asked for or accepted by, or offered or provided to, a specified class of persons is a permitted benefit.

The Health Insurance (Permitted benefitspathology services) Determination 2008 (the Principal Determination) sets out the benefits that are permitted, and the conditions under which they are permitted, in relation to pathology.

The Health Insurance (Permitted benefitspathology services) Amendment Determination 2008 (the Determination) amends the Principal Determination by:

(i)                 clarifying the description of a type of good currently listed in the Principle Determination (i.e “Punch biopsy” in item 15 of the table in item 9 of Schedule 1); and

(ii)               inserting a further type of good (“disposable vaginal speculums”) used for the collection of pathology specimens for testing by an accredited pathology laboratory as a permitted benefit.  This item was inadvertently omitted from the Principal Determination.

CONSULTATION

Section 18 of the Legislative Instruments Act 2003 specifically provides for circumstances where consultation may not be necessary or appropriate.  One of these circumstances is where the instrument is considered minor or machinery in nature, and does not substantially alter existing arrangements.

Because this Determination is amending the Principal Determination to:

(i) clarify the description of a type of good currently listed in the Principal Determination; and

(ii) include, as a permitted benefit, a type of good that had been inadvertently omitted from the Principal Determination;

the amendments to the Determination are considered to be minor and machinery in nature.

Extensive consultation was carried out with professional and industry bodies representing pathology providers during the development of the Principal Determination.

Therefore, no further consultation has been undertaken in the development of this Determination.

A detailed explanation of the provisions contained in the Determination is set out in the Attachment.

The Determination commences on the day after it is registered.

The Determination is a legislative instrument for the purposes of the Legislative Instruments Act 2003.

Overview

The Health Insurance (Permitted benefits – pathology services) Amendment Determination 2008, enacted under section 23DZZIG of the Health Insurance Act 1973, seeks to amend the existing Health Insurance (Permitted benefits – pathology services) Determination 2008. The primary objective of this amendment is to address minor oversights in the original determination, ensuring that the legislative framework governing permitted benefits in pathology services is accurate and comprehensive. The amendment was made by the Minister for Health and Ageing and is designed to maintain the integrity of the health insurance system by clearly defining what constitutes a permitted benefit. This includes clarifying the description of certain goods and including an omitted item, ensuring that all necessary items for pathology services are explicitly listed. The determination was introduced to correct inadvertent omissions and clarify certain descriptions in the initial legislation, thereby maintaining the effectiveness and fairness of the regulatory environment for pathology services. As the changes are minor and do not substantially alter existing arrangements, no further consultation was deemed necessary beyond what was already conducted for the original determination. The amendment ensures that the legislative instrument remains aligned with the policy objectives of the Health Insurance Act 1973, which aim to regulate benefits in a manner that prevents inducements and threats in the provision and request of pathology services.

Scope and Application

The Health Insurance (Permitted benefits – pathology services) Amendment Determination 2008 amends the Health Insurance (Permitted benefits – pathology services) Determination 2008 under section 23DZZIG of the Health Insurance Act 1973. This Determination applies to persons and entities involved in the provision or request of pathology services within the healthcare industry, specifically addressing the types of benefits that can be offered or accepted in relation to these services. It operates at a Commonwealth level, providing a national framework for the regulation of benefits associated with pathology services. The Determination does not specify exclusions or exemptions, but rather focuses on clarifying and including certain benefits that were inadvertently omitted in the original Principal Determination. The scope of the amendment is limited to minor and technical corrections, thus no further consultation was deemed necessary. This legislative instrument is effective from the day after its registration.

Key Provisions

The Health Insurance (Permitted benefits – pathology services) Amendment Determination 2008 amends the existing Health Insurance (Permitted benefits – pathology services) Determination 2008 under section 23DZZIG of the Health Insurance Act 1973. This amendment seeks to refine and correct the previous determination regarding the permitted benefits within the pathology services sector. Specifically, section 3 of the Amendment Determination amends Schedule 1 of the Principal Determination to adjust the description of one type of good, Punch biopsy instruments (item 15 in the table of item 9), and adds a new type of good, disposable vaginal speculums (item 30 in the same table), which was omitted in the original determination. The Amendment Determination imposes certain obligations on parties involved in the provision and request of pathology services. It mandates that the benefits offered or accepted between providers and requesters must fall within the category of "permitted benefits" as outlined in the Act and its determinations. This requirement ensures that any benefits related to pathology services are of a bona fide commercial nature and do not involve any inducements or threats that could compromise the integrity of the service provision. Providers and requesters must ensure that their transactions adhere to these permitted benefits to avoid contravening the Act. Failure to comply with the provisions of the Health Insurance Act 1973 and the related determinations can lead to various consequences. While the Act does not specify particular offences or penalties within the Amendment Determination itself, the broader Act provides for both civil and criminal penalties. Civil penalties can include fines, and in severe cases, criminal penalties can be imposed, which may involve imprisonment. The specific penalties depend on the nature and severity of the breach, as outlined in the main Act. Given the nature of the Amendment Determination as a minor and machinery amendment, the legislative process did not require further consultation beyond what was undertaken for the original Principal Determination. The amendment aims to correct and clarify existing provisions without substantially altering the established framework, thus maintaining the integrity and purpose of the regulatory regime surrounding pathology services. The Determination comes into effect on the day following its registration, ensuring that the changes are implemented promptly and efficiently.
