Overview

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – headspace National Youth Mental Health Foundation Ltd) Direction 2023 was enacted by the Australian Government Department of Health and Aged Care to address the gap in mental health services for young people in regional and remote areas. This Direction, under the Health Insurance Act 1973, aims to facilitate the payment of Medicare benefits for professional mental health services provided by headspace to eligible patients in these underserved regions. By ensuring that these services are recognised and compensated through Medicare, the Direction seeks to improve access to essential mental health care for young Australians in remote areas. This initiative is intended to support the broader policy objective of enhancing the availability and reach of primary health services across Australia, particularly in areas where such services are traditionally scarce.

Scope and Application

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – headspace National Youth Mental Health Foundation Ltd) Direction 2023 applies to the provision of professional services by headspace National Youth Mental Health Foundation Ltd under a Memorandum of Understanding with the Department of Health and Aged Care. It specifies that Medicare Benefits are payable for certain professional services listed in Schedule A, provided under the agreement to eligible persons in regional and remote areas, excluding those receiving services as part of a hospital treatment episode or attracting payments through the 2020-2025 Addendum to the National Health Reform Agreement for a service rendered to a public patient. The services must be provided at approved general practice locations, specifically those classified under Modified Monash Model 2-7, by general practitioners employed or contracted by the practice. The Direction applies across the Commonwealth of Australia and is in effect from 1 February 2023 until 30 June 2026 unless earlier revoked. The scope of the Act is extended through the schedules that list the specific items and practice locations covered by the Direction.

Key Provisions

The main operative sections of the Health Insurance (Medicare Benefits Payable in Respect of Professional Services – headspace National Youth Mental Health Foundation Ltd) Direction 2023, issued under the Health Insurance Act 1973, direct that Medicare Benefits are payable for specific professional services agreed upon between the Department of Health and Aged Care and headspace National Youth Mental Health Foundation Ltd. These services are provided in regional and remote areas, with the specified items listed in Schedule A of this Direction and the general medical services table under subsection 4(1) of the Health Insurance Act 1973. The professional services must be provided to eligible persons who are not receiving the service as part of an episode of hospital treatment or as a public patient under the National Health Reform Agreement. The services must also be provided at general practice locations specified in Schedule B, within the Modified Monash Model 2-7, by a general practitioner employed or contracted by the practice. This Direction imposes specific obligations on the parties involved. The Department of Health and Aged Care, along with headspace National Youth Mental Health Foundation Ltd, must ensure that the professional services outlined in the Direction are provided as agreed upon in the Memorandum of Understanding. Eligible patients must be identified, and the services must be rendered at the specified rural or remote practice locations. General practitioners must be employed or contracted by the practice to provide these services. The Direction does not explicitly detail offences, penalties, or civil/criminal consequences for breach within its text. However, any breach of the conditions set out in the Direction could potentially lead to consequences under the Health Insurance Act 1973, the National Health Act 1953, or other relevant legislation. These could include administrative penalties, fines, or other corrective measures deemed appropriate by the relevant authorities. It is important to note that the exact penalties would be determined in accordance with the specific provisions of the applicable Acts and regulations.
