Health Insurance (Medicare Benefits Payable in Respect of Professional Services –Commonwealth Urgent Care Clinic Locations – New South Wales) Direction 2023

I, Nigel Murray, Assistant Secretary, MBS Policy and Specialist Programs Branch, Medicare Benefits and Digital Health Division, Health Resourcing Group, delegate for the Minister for Health and Aged Care, acting under subsection 19(2) of the Health Insurance Act 1973, hereby:

  1. DIRECT that Medicare Benefits shall be payable in respect of:

 

(a)   A professional service (as defined in Section 3 of the Health Insurance Act 1973) which has been agreed to be provided:

(i)     between the Commonwealth (represented by the Department of Health and Aged Care, ABN: 83 605 426 759) and the State of New South Wales (represented by the New South Wales Department of Health, ABN: 92 697 899 630) by the Campbelltown Medicare Urgent Care Clinic that has been assessed as meeting the requirements of the Commonwealth Urgent Care Clinic program; and

(ii)  as part of the Commonwealth Urgent Care Clinic Program for which items specified in Schedule A of this Direction; and of the general medical services table (means the table prescribed under subsection 4(1) of the Health Insurance Act 1973) relates; and

 

(a)   Where the professional service is provided to:

(i)     an eligible person (as defined in Section 3 of the Health Insurance Act 1973);

(ii)  a patient who is not receiving the service as part of an episode of hospital treatment (as defined in Section 121-5 of the Private Health Insurance Act 2007);

(iii)  a patient who also is not receiving a service:

  1. which attracts a payment through the 2020-2025 Addendum to the National Health Reform Agreement for a service rendered to a public patient; or
  2. which attracts a payment through another government arrangement outside of the Commonwealth Urgent Care Clinic program for a service rendered to the patient; and

 

(b)   the professional services referred to in clause (a) must be provided:

(i)     at a general practice (as defined in Section 7.1.1 of the general medical services table); and

(ii)  by a general practitioner or participating nurse practitioner mentioned in (a) who is registered to provide services, in Schedule A, with Services Australia under the Commonwealth Urgent Care Clinic program.

 

DECLARED that this Direction commences on 1 November 2023 and ceases to have effect at the end of 30 June 2026 unless earlier revoked.

Overview

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Urgent Care Clinic Locations – New South Wales) Direction 2023 was enacted to address the need for urgent care services in New South Wales and to facilitate the agreement between the Commonwealth and the State of New South Wales for the operation of the Campbelltown Medicare Urgent Care Clinic. The Direction was issued under subsection 19(2) of the Health Insurance Act 1973 by Nigel Murray, the Assistant Secretary for the MBS Policy and Specialist Programs Branch of the Department of Health and Aged Care. The primary policy objective of this Direction is to ensure that Medicare benefits are payable for professional services provided by the Campbelltown Medicare Urgent Care Clinic, which has been assessed to meet the requirements of the Commonwealth Urgent Care Clinic program. The Direction sets out the conditions under which these benefits are payable, including the type of services, the practitioners who can provide them, and the eligibility of patients. The Direction is effective from 1 November 2023 and will remain in force until 30 June 2026, unless earlier revoked. Scope and Application

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Urgent Care Clinic Locations – New South Wales) Direction 2023 applies to professional services agreed to be provided by the Campbelltown Medicare Urgent Care Clinic as part of the Commonwealth Urgent Care Clinic Program. This Direction is applicable to the professional services provided at the Campbelltown location, as assessed and meeting the requirements of the program. It specifies that Medicare Benefits will be payable in respect of these services provided to eligible persons, excluding those receiving hospital treatment or services under other government arrangements. The professional services must be provided at a general practice by registered general practitioners or participating nurse practitioners under the Commonwealth Urgent Care Clinic program. Key Provisions

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Urgent Care Clinic Locations – New South Wales) Direction 2023 (the Direction) stipulates that Medicare benefits will be payable for professional services provided under a specific agreement between the Commonwealth and the State of New South Wales (section 1). This includes services that meet the requirements of the Commonwealth Urgent Care Clinic (CUC) program and are listed in Schedule A (section 1(a)(i)). The Direction is effective from 1 November 2023 and will cease on 30 June 2026 unless revoked earlier (section 2). Entities and individuals governed by this Direction must ensure that the professional services rendered fall within the agreed terms of the CUC program and comply with the stipulated requirements, including the location and type of service provider (section 1). Specifically, service providers must be registered with Services Australia under the CUC program and provide services at an approved general practice (section 1(b)). Furthermore, the services must be provided to eligible patients who do not qualify for other government arrangements, as specified (section 1(a)(iii)). Failure to adhere to these conditions could result in non-payment of Medicare benefits for the services rendered. Breaches of the provisions set out in this Direction may lead to civil and criminal consequences. While the Direction does not specify penalties, non-compliance with the Health Insurance Act 1973 or associated regulations could result in fines or other penalties as provided by law. Specifically, unauthorised claims for Medicare benefits or fraudulent activities could attract penalties under sections 126A and 126B of the Health Insurance Act 1973, which include substantial fines and potential imprisonment. It is essential for all parties to comply strictly with the terms of the Direction to avoid any legal repercussions.
