Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Victoria) Direction (No. 1) 2025

I, Nigel Murray, Assistant Secretary, MBS Policy and Specialist Programs Branch, Medicare Benefits and Digital Health Division, Health Resourcing Group, delegate for the Minister for Health and Ageing, acting under subsection 19(2) of the Health Insurance Act 1973 (the Act), hereby:

  1.                REPEAL the Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Urgent Care Clinic Program – Victoria) Direction (No. 2) 2024; and
  2.                DIRECT that Medicare Benefits shall be payable in respect of:
  1.      A professional service (as defined in section 3 of the Act which has been agreed to be provided:
    1.        under a Schedule to the Federation Funding Agreement executed on
      28 June 2023 between the Commonwealth (represented by the Department of Health and Aged Care, ABN: 83 605 426 759) and the State of Victoria (represented by the Victorian Department of Treasury and Finance, ABN: 44 128 890 975); and
    2.      as part of the Commonwealth Urgent Care Clinic Program for which items specified in Schedules A, B and C of this Direction; and of the general medical services table (means the table prescribed under subsection 4(1) of the Act) , the diagnostic imaging services table (means the table prescribed under section 4AA of the Act) or the pathology service table (means the table prescribed under section 4A of the Act) relates; and
  2.      Where the professional service is provided to:
  1.        an eligible person (as defined in section 3 of the Act);
  2.      a patient who is not receiving the service as part of an episode of hospital treatment (as defined in section 121-5 of the Private Health Insurance Act 2007); and
  3.   a patient who also is not receiving a service which attracts a payment through the 2020-2025 Addendum to the National Health Reform Agreement for a service rendered to a public patient; and
  1.      The professional services referred to in paragraph (2)(a) must be provided:
    1.        if the service is specified in Schedule A:
      1.    at a practice location specified in Schedule D or E of this Direction; and
      2.     by a general practitioner, prescribed medical practitioner or participating nurse practitioner who is registered to provide services with Services Australia under the Commonwealth Urgent Care Clinic program mentioned in paragraph (2)(a).
    2.      if the service is specified in Schedule B:
      1.    at a practice location specified in Schedule D of this Direction; and
      2.     by a prescribed medical practitioner who is registered to provide services with Services Australia under the Commonwealth Urgent Care Clinic program mentioned in paragraph (2)(a).
    3.   if the service is specified in Schedule C:
    1.    at a practice location specified in Schedule E of this Direction; and
    2.     by a prescribed medical practitioner who is registered to provide services with Services Australia under the Commonwealth Urgent Care Clinic program mentioned in paragraph (2)(a).
  1.                DECLARE that this Direction commences on the day after registration and ceases to have effect at the end of 30 June 2026 unless earlier revoked.

Note, a number of expressions used in this direction are defined in the below instruments:

  • Health Insurance Act 1973: the meaning of general practitioner, participating nurse practitioner and professional service; and
  • Health Insurance (General Medical Services Table) Regulations 2021: the meaning of prescribed medical practitioner.

Overview

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Victoria) Direction (No. 1) 2025, issued under the Health Insurance Act 1973, aims to facilitate the payment of Medicare benefits for professional services provided under the Commonwealth Medicare Urgent Care Clinic Program in Victoria. Enacted by the Australian Government Department of Health, Disability and Ageing, this direction addresses the need for streamlined medical service provisions in specific locations to enhance healthcare accessibility and efficiency. The policy objective is to ensure that eligible patients receive timely and appropriate medical services through registered practitioners at designated urgent care clinic locations, thereby improving healthcare outcomes and service delivery in Victoria.

Scope and Application

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Victoria) Direction (No. 1) 2025 applies to the Commonwealth, specifically under the Health Insurance Act 1973, and pertains to the provision of professional services through the Commonwealth Medicare Urgent Care Clinic Program in Victoria. This direction, made by the Assistant Secretary, MBS Policy and Specialist Programs Branch, Medicare Benefits and Digital Health Division, Health Resourcing Group, Department of Health, Disability and Ageing, mandates that Medicare Benefits are payable for specific professional services as outlined in the Direction. These services must be provided under the terms of a Schedule to the Federation Funding Agreement executed between the Commonwealth and the State of Victoria, and must relate to items specified in the general medical services table, diagnostic imaging services table, or pathology services table. The services must be provided to eligible persons who are not receiving the service as part of an episode of hospital treatment or as a service attracting a payment through the 2020-2025 Addendum to the National Health Reform Agreement for a service rendered to a public patient. The professional services must be rendered by registered medical practitioners or nurse practitioners at specified practice locations in accordance with the Direction. This Direction repeals the previous Direction (No. 2) 2024 and is effective from the day after registration, expiring on 30 June 2026 unless earlier revoked. The scope of the Direction is further defined by its Schedules, which detail the specific items eligible for Medicare Benefits and the approved practice locations in Metropolitan Melbourne Statistical Divisions (MMM) 1 and 2-7.

Key Provisions

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Victoria) Direction (No. 1) 2025 (the Direction) provides for the payment of Medicare Benefits for professional services under the Commonwealth Medicare Urgent Care Clinic Program in Victoria. It replaces the previous Direction (No. 2) 2024. Medicare Benefits are payable for professional services agreed to be provided under the Federation Funding Agreement between the Commonwealth and the State of Victoria, and which are part of the Commonwealth Urgent Care Clinic Program. These services must be provided to eligible persons, who are not receiving hospital treatment or a service covered by the 2020-2025 Addendum to the National Health Reform Agreement for a public patient. The services must also be provided by authorised practitioners at specified locations. The Direction specifies which professional services are covered, including general medical services, diagnostic imaging services, and pathology services, and it lists the corresponding item numbers in Schedules A, B, and C. The Direction also specifies the approved practice locations in Schedules D and E, depending on whether the clinic is located in Melbourne Metropolitan Area (MMA) 1 or MMA 2-7. The Direction imposes several obligations on the parties involved. Firstly, it requires that the professional services be provided under the Federation Funding Agreement and as part of the Commonwealth Urgent Care Clinic Program. Secondly, the services must be provided by authorised practitioners, which include general practitioners, prescribed medical practitioners, and participating nurse practitioners who are registered with Services Australia for the program. Thirdly, the services must be provided at the approved practice locations listed in Schedules D and E, depending on the location of the clinic. Fourthly, the services must be provided to eligible persons who are not receiving hospital treatment or a service covered by the 2020-2025 Addendum to the National Health Reform Agreement for a public patient. The Direction also declares that it will commence on the day after registration and cease to have effect at the end of 30 June 2026 unless earlier revoked. There are no specific offences, penalties, or civil/criminal consequences outlined in the Direction itself for breach of its provisions. However, any breach of the Health Insurance Act 1973 or the regulations made under it, or the National Health Act 1953 and regulations made under it, could result in penalties or consequences as prescribed by those Acts and regulations. The penalties for contravening the Health Insurance Act 1973 can include fines of up to $22,200 for individuals and $111,000 for bodies corporate, as well as potential criminal charges in serious cases. The penalties for contravening the National Health Act 1953 can include fines of up to $1,650 for individuals and $8,250 for bodies corporate.
