Overview

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Tasmania) Direction (No. 2) 2024 was enacted by the Australian Government Department of Health and Aged Care to address the need for a more structured and funded urgent care service in Tasmania. This direction revokes the previous Direction from 2024 and outlines the terms under which Medicare Benefits will be payable for professional services provided as part of the Commonwealth Medicare Urgent Care Clinic Program in Tasmania. The Direction is effective from 1 November 2024 and will cease to have effect at the end of 30 June 2026 unless earlier revoked. The policy objective is to ensure that eligible persons in Tasmania have access to necessary urgent care services through authorised clinics and practitioners, while ensuring that these services do not overlap with other funded healthcare services such as hospital treatment or public patient services. The Direction specifies the items covered under the program and the approved practice locations where these services can be rendered.

Scope and Application

The Health Insurance (Medicare Benefits Payable in Respect of Professional Services – Commonwealth Medicare Urgent Care Clinic Program – Tasmania) Direction (No. 2) 2024 applies to professional services provided under the Commonwealth Medicare Urgent Care Clinic Program in Tasmania. This Direction revokes the previous Direction issued on 13 December 2023 and specifies that Medicare Benefits are payable for professional services agreed to be provided under the Federation Funding Agreement executed on 1 June 2023 between the Commonwealth and the Tasmanian Premier Minister for Health. These services must be part of the general medical services table or pathology service table, provided at approved practice locations by registered general practitioners, prescribed medical practitioners, or participating nurse practitioners who are part of the Commonwealth Medicare Urgent Care Clinic program. The Direction outlines that the professional services must be provided to eligible persons who are not receiving the service as part of an episode of hospital treatment or a service attracting a payment under the 2020-2025 Addendum to the National Health Reform Agreement for a service rendered to a public patient. This Direction commences on 1 November 2024 and will cease to have effect on 30 June 2026 unless earlier revoked. Definitions of terms such as general practitioner, participating nurse practitioner, and professional service are provided in the Health Insurance Act 1973, while the meaning of prescribed medical practitioner is defined in the Health Insurance (General Medical Services Table) Regulations 2021.

Key Provisions

The main operative sections of this Direction (No. 2) include the revocation of the previous Direction (2024) (section 2) and the establishment of a new Direction to allow Medicare Benefits payable for certain professional services in Tasmania (section 3). Specifically, Medicare Benefits will be payable for professional services provided under the Federation Funding Agreement between the Commonwealth and the Tasmanian government, as part of the Commonwealth Medicare Urgent Care Clinic Program (section 3(2)(a)). These services must be specified in Schedule A of this Direction and relate to the general medical services table or pathology service table (section 3(2)(a)). The services must be provided to an eligible person, not as part of an episode of hospital treatment, and not as a service that attracts payment through the 2020-2025 Addendum to the National Health Reform Agreement for a public patient (section 3(2)(b)). The services must be provided at a practice location specified in Schedule B and by a general practitioner, prescribed medical practitioner, or participating nurse practitioner registered to provide services under the program (section 3(2)(c)). The Direction imposes several obligations and requirements on the parties involved. First, the Commonwealth and the Tasmanian government must ensure that the professional services provided are those agreed upon under the Federation Funding Agreement and listed in Schedule A. This includes adhering to the specific items and services outlined in the General Medical Services Table and Pathology Services Table. Second, the services must be provided at the approved practice locations listed in Schedule B. Third, the professionals providing the services must be appropriately registered and qualified to do so under the Commonwealth Medicare Urgent Care Clinic Program. Additionally, the services must not be provided as part of a hospital episode of treatment or as a service attracting payment through the 2020-2025 Addendum to the National Health Reform Agreement. The Direction does not explicitly state specific offences or penalties for breaches, but it is implied that any non-compliance with the requirements set out in the Act and regulations could lead to legal consequences. Given the context of the Health Insurance Act 1973 and related regulations, breaches could potentially result in civil or criminal penalties, including fines or other sanctions. The maximum penalties would depend on the specific breach and the provisions of the Act or related regulations that are contravened. However, detailed penalties are not specified in this Direction, and further reference to the Health Insurance Act and relevant regulations would be necessary to determine the exact consequences of a breach.
