1 Name
This instrument is the Health Insurance (Medicare Benefits Payable in Respect of Professional Services and Screening Services – Aboriginal Community Controlled Health Services) Direction (No. 1) 2026.
2 Commencement
(1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3 Authority
This instrument is made under subsection 19(2) and 19(5) of the Act.
4 Repeals
This instrument is repealed on 30 June 2032 at 11:59pm, unless repealed earlier.
5 Definitions
Aboriginal and Torres Strait Islander primary health care professional has the meaning given by subsection 4(1) of the Health Insurance (Section 3C General Medical Services – Allied Health and other Primary Health Care Services) Determination 2024.
Act means the Health Insurance Act 1973.
allied health professional has the meaning given by subsection 4(1) of the Health Insurance (Section 3C General Medical Services – Allied Health and other Primary Health Care Services) Determination 2024
dental practitioner has the meaning given by subsection 3(1) of the Act.
diagnostic imaging services table means the table prescribed under section 4AA of the Act.
eligible Aboriginal and Torres Strait Islander health practitioner has the meaning given by subsection 4(1) of the Health Insurance (Section 3C General Medical Services – Allied Health and other Primary Health Care Services) Determination 2024.
eligible Aboriginal and Torres Strait Islander health worker has the meaning given by subsection 4(1) of the Health Insurance (Section 3C General Medical Services – Allied Health and other Primary Health Care Services) Determination 2024.
eligible person has the meaning given by subsection 3(1) of the Act.
general medical services table means the table prescribed under section 4 of the Act.
general practice has the meaning given by Part 7.1.1 of the Health Insurance (General Medical Services Table) Regulations 2021.
general practitioner has the meaning given by subsection 3(1) of the Act.
hospital treatment has the meaning given by section 121‑5 of the Private Health Insurance Act 2007.
MBS means the Medicare Benefits Schedule.
MMM means the Modified Monash Model.
optometrist has the meaning given by subsection 3(1) of the Act.
participating midwife has the meaning given by subsection 3(1) of the Act.
participating nurse practitioner has the meaning given by subsection 3(1) of the Act.
pathology services table means the table prescribed under section 4A of the Act.
professional service has the meaning given by subsection 3(1) of the Act.
prescribed medical practitioner has the meaning given by Part 7.1.1 of the Health Insurance (General Medical Services Table) Regulations 2021.
6 Medicare benefits payable in respect of the Aboriginal Community Controlled Health Services under subsection 19(2) of the Act
A Medicare benefit shall be payable in respect of a professional service where the following are met.
- The professional service has been agreed to be provided as part of the Indigenous Australians’ Health Program between the Department of Health, Disability and Ageing (ABN: 83 605 426 759) and the organisations listed in Schedule 2 of this instrument.
- The professional service is provided to the following:
- an eligible person;
- a patient who is not receiving the service as part of an episode of hospital treatment;
- a patient who is not receiving a service which attracts a payment through the National Health Reform Agreement - Addendum 2026-2031 for a service rendered to a public patient.
- The professional service corresponds with an MBS group, subgroup or item specified in Schedule 1 of this instrument.
- The professional service must be provided:
- by, or on behalf of, a salaried medical practitioner, or by a salaried participating midwife or participating nurse practitioner, where the service is a non-referred professional service; or
- by a salaried allied health professional, dental practitioner, optometrist, eligible Aboriginal and Torres Strait Islander health practitioner or eligible Aboriginal health worker, where the service is a referred professional service; and
- by a person who is employed or engaged by an organisation listed in Schedule 2 of this instrument.
7 Medicare benefits payable in respect of screening serviced rendered at Aboriginal Community Controlled Health Services under subsection 19(5) of the Act
A Medicare benefit shall be payable in respect of a pathology service to which an item of the pathology services table prescribed under section 4A of the Act relates in the following circumstances:
- the pathology service is provided or requested by a person employed or engaged by an organisation listed in Schedule 2 of this instrument; and
- the service is requested or provided as part of a health screening program for the detection and management of sexually transmissible infections, diabetes, renal or cardiovascular disease in Aboriginal and Torres Strait Islander communities.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
