Overview

The Health Insurance (Diagnostic Imaging – Continuing Medical Education and Quality Assurance Programs) Approval 2000, enacted on 1 January 2001, addresses the need for continuous professional development and quality assurance in the field of diagnostic imaging for health service providers. This legislative instrument was made by MICHAEL RICHARD LEWIS WOOLDRIDGE, the Minister for Health and Aged Care, under the authority of subsection 23DSB(1) of the Health Insurance Act 1973. The primary objective of this Approval is to formalise and recognise specific programs designed to enhance the skills and maintain the standards of medical professionals involved in diagnostic imaging, thereby ensuring the delivery of high-quality healthcare services. By approving certain programs provided by designated organisations, the legislation aims to foster ongoing education and quality control within the medical community, ultimately benefiting patient care and outcomes.

Scope and Application

The Health Insurance (Diagnostic Imaging — Continuing Medical Education and Quality Assurance Programs) Approval 2000 applies to specific programs of continuing medical education and quality assurance provided for providers of diagnostic imaging services. These programs are outlined in Schedule 1 of the Approval and are delivered by specific organisations, such as the Australian College of Rural and Remote Medicine and the Royal Australian College of General Practitioners. The legislation is an instrument under subsection 23DSB(1) of the Health Insurance Act 1973 and is administered by the Minister for Health and Aged Care. The Approval came into effect on 1 January 2001 and pertains to the Commonwealth jurisdiction. It does not explicitly state any exclusions or exemptions, but rather identifies approved programs and providers, thereby implicitly excluding any programs not listed in Schedule 1 or provided by the specified organisations. The scope and details of the programs may be further elaborated through subordinate instruments.

Key Provisions

The Health Insurance (Diagnostic Imaging — Continuing Medical Education and Quality Assurance Programs) Approval 2000 outlines the specific programs that are recognised for continuing medical education and quality assurance in relation to providers of diagnostic imaging services. As per section 4, this Approval recognises two particular programs: the General Practitioner Radiology Program provided by the Australian College of Rural and Remote Medicine (item 1 of Schedule 1) and the Quality Assurance and Continuing Education Program provided by the Royal Australian College of General Practitioners (item 2 of Schedule 1). These programs are essential for ensuring that diagnostic imaging providers maintain high standards of medical practice and quality assurance. Entities such as the Australian College of Rural and Remote Medicine and the Royal Australian College of General Practitioners have the obligation to deliver the approved programs as specified in Schedule 1 of the Approval. This requirement ensures that diagnostic imaging providers have access to structured and recognised continuing medical education and quality assurance initiatives. The providers of these programs must adhere to the criteria and standards set out in the Act, which aims to foster ongoing professional development and uphold the quality of diagnostic imaging services. Breaches of the obligations under this Approval may not be explicitly detailed in the legislative instrument, but the Health Insurance Act 1973 provides a framework for addressing non-compliance. Under the Act, there are potential civil or criminal consequences for failing to meet the requirements of approved programs. For instance, penalties could include fines, which are determined according to the severity of the breach and the provisions of the Act. It is crucial for the entities providing the approved programs to ensure full compliance to avoid any legal repercussions.
