PRIVATE HEALTH INSURANCE BRANCH

DEPARTMENT OF HEALTH AND AGEING

SEPTEMBER 2007

Overview

The Health Insurance Act 1973 was enacted to establish a national scheme of private health insurance in Australia, ensuring access to affordable healthcare services. This legislation was introduced by the Australian Parliament to address the need for a structured and equitable private health insurance system. The Act empowers the Minister for Health and Ageing to determine various aspects of the insurance scheme, including patient contributions for specific services. The determination under subsection 3(1) of the Act, specifically HIB 17/2007, sets the patient contribution levels for nursing-home type patients in recognized hospitals. This determination, effective from 20 September 2007, established the patient contribution amount at $39.05 per day for recognized hospitals in Tasmania, reflecting the policy objective of maintaining fair and consistent healthcare costs across the nation. The Department of Health and Human Services was consulted and advised on the implementation of these new rates from the specified date.

Scope and Application

The Health Insurance Act 1973, under the authority of the Minister for Health and Ageing, sets out the framework for regulating the private health insurance industry in Australia, with this particular determination focusing on the patient contributions for nursing-home type patients in recognised hospitals. This determination applies specifically to patients in recognised hospitals in Tasmania, setting the patient contribution rate at $39.05 per day, effective from 20 September 2007. The Act applies to all patients in recognised hospitals who are classified as nursing-home type patients in Tasmania, ensuring that these individuals are charged a consistent and determined amount for their healthcare services. The jurisdictional reach of this Act is within the Commonwealth of Australia, specifically targeting recognised hospitals in Tasmania. The Act does not specify any exclusions, exemptions, or thresholds beyond the geographic and patient type limitations, and its application can be extended or restricted through further subordinate instruments as needed.

Key Provisions

The Health Insurance Act 1973, through its subsection 3(1), defines a 'patient contribution' as a charge made by a recognised hospital to a patient for certain services. Specifically, paragraph (b) of this definition allows the Minister to determine the levels of patient contribution for nursing-home type patients. This authority is exercised in the determination HIB 17/2007, which sets the patient contribution amount for such patients in recognised hospitals in Tasmania at $39.05 per day, effective from 20 September 2007. This determination aligns with the legislative framework provided in the Act, ensuring that the financial burden on patients in nursing home care is regulated and transparent. Under the Act, recognised hospitals in Tasmania are obligated to charge the determined patient contribution of $39.05 per day to nursing-home type patients from the specified commencement date. This requirement ensures that there is a standardised charge across all recognised hospitals within the state, promoting fairness and consistency in the healthcare system. Additionally, these hospitals must adhere to any other provisions outlined in the Health Insurance Act 1973, ensuring that all patient contributions are correctly applied and accounted for. Failure to comply with the patient contribution determination could result in legal consequences. While the Act does not explicitly state the penalties for non-compliance, breaches of such legislative requirements may be subject to administrative or judicial review. This could lead to fines, corrective orders, or other enforcement actions by the relevant health authorities. The precise nature and extent of these consequences would depend on the specific circumstances of the breach and the discretion of the authorities overseeing compliance with the Act. The determination is designed to provide clarity and predictability in the healthcare system, ensuring that patients and hospitals alike understand their financial obligations and entitlements. By setting a clear patient contribution amount, the Act aims to protect the interests of nursing-home type patients while ensuring the sustainability of the healthcare system. The Department of Health and Human Services’ consultation and subsequent implementation of these rates further underscore the commitment to maintaining a fair and regulated healthcare environment in Tasmania.
