PRIVATE HEALTH INSURANCE BRANCH

DEPARTMENT OF HEALTH AND AGEING

JUNE 2008

Overview

The Health Insurance Act 1973, enacted by the Commonwealth Parliament, provides the legislative framework for the regulation of private health insurance in Australia, with a focus on ensuring the sustainability and effectiveness of the private health insurance system. This Act was introduced to address gaps in the regulation and administration of private health insurance, ensuring that consumers have access to affordable and comprehensive health coverage. The 2008 determination under subsection 3(1) of the Act, specifically concerning patient contributions for nursing-home type patients in recognised hospitals, exemplifies the ongoing adjustments made to the legislation to reflect changing healthcare needs and economic conditions. This determination, made by the Minister for Health and Ageing, aims to establish a consistent and fair patient contribution level for nursing-home type patients in Western Australia, reflecting the policy objective of maintaining equitable access to necessary healthcare services. The consultation with the Western Australia Department of Health ensures that the new rates are practically implemented, thereby supporting the broader goals of the Health Insurance Act.

Scope and Application

The Health Insurance Act 1973, as amended by the determination under subsection 3(1)(HIB 10/2008), applies to nursing-home type patients of recognised hospitals in Western Australia. This legislative action pertains specifically to the financial contributions expected from these patients, setting a fixed amount of $39.70 per day, effective from 1 July 2008. The determination is applicable to the individual patients who fall under the nursing-home type classification within recognised hospitals in the state of Western Australia. This legislative instrument extends to setting the financial burden on these patients without explicitly excluding any sub-categories or imposing additional thresholds beyond the specified daily contribution. The application of this Act is confined to the state level, impacting only those hospitals within Western Australia that have been recognised under the provisions of the Health Insurance Act 1973. The Act does not extend to other states or territories, nor does it mention any subordinate instruments that might further elaborate on its application.

Key Provisions

The Health Insurance Act 1973 (the Act) allows the Minister to determine the levels of patient contributions for nursing-home type patients in recognised hospitals in each State (section 3(1)(HIB 10/2008)). This determination sets the patient contribution for recognised hospitals in Western Australia at $39.70 per day, effective from 1 July 2008. The Western Australia Department of Health has confirmed it will implement these new rates from the specified date. This means that from 1 July 2008, any nursing-home type patient in a recognised hospital in Western Australia will be required to pay this amount as their contribution. Under the Act, the obligations imposed on the parties include the requirement for recognised hospitals in Western Australia to apply the determined patient contribution rate of $39.70 per day. This applies to all nursing-home type patients admitted to these hospitals from the commencement date of 1 July 2008. The Western Australia Department of Health has the responsibility to ensure that these rates are correctly applied and communicated to relevant parties, ensuring compliance with the Act. Failure to comply with the provisions of this determination could lead to breaches of the Act. Although specific offences, penalties, or consequences for non-compliance are not detailed in this determination, breaches of the Health Insurance Act 1973 generally can lead to civil or criminal penalties. These may include fines or other sanctions as prescribed by the Act, depending on the nature and severity of the breach. The maximum penalties for such breaches are determined in accordance with the specific sections of the Act that are contravened.
