Overview

The Health Insurance Act 1973, as amended through the F2008L02176 determination, was enacted to address the issue of setting patient contribution levels for nursing-home type patients in recognised hospitals within the Northern Territory. This specific determination, made under subsection 3(1) of the Act, empowers the Minister for Health and Ageing to adjust these contribution levels periodically, ensuring they are reflective of current economic and healthcare conditions. The policy objective is to provide a transparent and consistent framework for calculating patient contributions, which helps to manage healthcare costs effectively and ensure fair access to services for all patients. The determination, effective from 1 July 2008, sets the patient contribution at $39.70 per day for recognised hospitals in the Northern Territory, following consultation with the Department of Health and Community Services, Northern Territory, which has agreed to implement the new rates from the specified date.

Scope and Application

The Health Insurance Act 1973 applies to individuals who are eligible for health insurance benefits, health insurance providers, and recognised hospitals, particularly those within the internal territories of Australia. This Act facilitates the provision of health insurance services and ensures that patients receive appropriate coverage for their medical needs. Specifically, the Act's determination under subsection 3(1)(HIB 08/2008) establishes the patient contribution levels for nursing-home type patients in recognised hospitals within the Northern Territory. This contribution, set at $39.70 per day from 1 July 2008, applies to patients staying in hospitals recognised under the Act within the Northern Territory. The Department of Health and Community Services, Northern Territory, was consulted and has confirmed the implementation of these new rates. The jurisdiction of this determination is limited to the Northern Territory, and it is effective from 1 July 2008. The application of this Act and its determinations may be extended or modified through subordinate instruments issued by the Minister for Health and Ageing.

Key Provisions

The main operative sections of this determination under subsection 3(1)(HIB 08/2008) of the Health Insurance Act 1973 (the Act) specify the patient contribution levels for nursing-home type patients in recognised hospitals in the Northern Territory. Section 3(1) of the Act provides that the Minister may determine these levels, and this determination sets the amount of patient contribution at $39.70 per day, effective from 1 July 2008. This determination is specifically made for internal Territory purposes and applies to nursing-home type patients in recognised hospitals within the Northern Territory. The consultation with the Department of Health and Community Services, Northern Territory has confirmed the applicability of these new rates starting from 1 July 2008. The obligations and requirements imposed by this determination on the parties it governs are primarily administrative in nature. Recognised hospitals within the Northern Territory are required to implement the new patient contribution rates of $39.70 per day for nursing-home type patients from the specified commencement date of 1 July 2008. These hospitals must ensure that the new rates are accurately applied in billing and patient contribution calculations. The Department of Health and Community Services, Northern Territory, which has been consulted, will likely oversee the implementation and compliance with these new rates to ensure that they are correctly applied in practice. There are no explicit offences, penalties, or civil/criminal consequences stated in this determination for breach of the new patient contribution rates. However, it is implied that any failure to comply with the specified rates could lead to administrative scrutiny or corrective actions by the relevant health authorities. While the determination does not outline specific penalties, the general legal framework under which it operates may include provisions for fines or other administrative penalties for non-compliance with health-related regulations. It is important for recognised hospitals to adhere to the new rates to avoid any potential repercussions that may arise from non-compliance.
