PRIVATE HEALTH INSURANCE BRANCH

DEPARTMENT OF HEALTH AND AGEING

MARCH 2007

Overview

The Health Insurance Act 1973, as amended by the HIB 06/2007 determination, establishes the framework for the regulation of private health insurance in Australia. This particular determination under subsection 3(1) addresses the gap in setting specific patient contribution levels for nursing-home type patients in recognized hospitals within South Australia. Enacted by the Australian Government through the Department of Health and Ageing, the policy objective is to provide clarity and consistency in the patient contributions for such services. The Department of Health in South Australia has been consulted and will implement the new rates from 20 March 2007. This legislative action aims to ensure that patients in South Australian nursing homes have a clearly defined financial contribution, facilitating more predictable and equitable healthcare costs within the state.

Scope and Application

The Health Insurance Act 1973, through the determination under subsection 3(1) of HIB 06/2007, specifically addresses the patient contributions for nursing-home type patients in recognised hospitals in South Australia. The Act applies to individuals who are nursing-home type patients in hospitals recognised under the Act, which includes those receiving care in facilities recognised as hospitals in South Australia. The determination sets the patient contribution at $38.20 per day, effective from 20 March 2007, and applies only to these patients within the state of South Australia. The Department of Health in South Australia was consulted and has agreed to implement this new rate in recognised hospitals from the specified date. This determination is a Commonwealth regulation extending the Act's provisions to specify the patient contribution amount, with no exclusions or exemptions mentioned in this context. The determination and its explanatory statement have been registered on the Federal Register of Legislative Instruments to ensure legal clarity and enforceability.

Key Provisions

The key operative section in this determination under subsection 3(1) of the Health Insurance Act 1973 (the Act) pertains to the patient contribution levels for nursing-home type patients in recognized hospitals (subsection 3(1)(HIB 06/2007)). This provision allows the Minister to set the daily contribution amount for such patients. Specifically, the determination establishes that from 20 March 2007, the patient contribution for nursing-home type patients in recognized hospitals in South Australia will be $38.20 per day. This determination aligns with the statutory authority granted under the Act and aims to provide clarity and consistency in the financial obligations for these patients. The obligations imposed by this determination primarily concern recognised hospitals in South Australia. These institutions are required to apply the specified patient contribution rate of $38.20 per day for nursing-home type patients starting from 20 March 2007. This requirement ensures that there is a uniform application of the contribution rates across all recognised hospitals in the state, thereby maintaining fairness and predictability in the healthcare financing system. The Department of Health, South Australia has been consulted and has indicated its intention to implement these new rates from the specified date. There are no explicit offences, penalties, or civil/criminal consequences outlined in this determination. However, any non-compliance by recognised hospitals in South Australia with the specified patient contribution rates could potentially lead to administrative actions or investigations under the Health Insurance Act 1973. While the determination itself does not specify penalties, deviation from the stipulated rates might attract scrutiny from regulatory authorities, resulting in corrective measures to ensure adherence to the Act's provisions. It is important for recognised hospitals to comply with the set contribution rates to avoid any potential repercussions under the Act.
